NOTICE INVITING BIDS
Notice is hereby given that sealed bids will be received by the Union Sanitary District in their office located at 5072 Benson Road, Union City, CA 94587-2508, at any time prior to 2:00:00 p.m. on August 29, 2023 for furnishing all labor, materials, equipment, and services for the construction of improvements designated as:

Force Main Corrosion Repairs Project – Phase 4
Project No. 800-575

The project consists of:

Removing and replacing manways and appurtenances of air release valves, blow offs and access manways located along the District’s twin force mains
Welding new steel components
Sandblasting and painting/coating existing and new components
Access Improvements for nine sites
Repairing three (3) Concrete Flat Slab Top
Removing and Replacing three (3) Concrete Flat Slab Top, Access Hatch, and Vent Piping
Injecting twenty-three (23) manholes with chemical grout to address Inflow and Infiltration
Implementing biological control measures/BMPs

The successful bidder will have three-hundred and fifty (350) calendar days to complete the Project from the Notice to Proceed, regardless of whether any or all bid alternates are selected by the District.

The Engineer’s Estimate for this Project is $2,450,000.

In accordance with Public Contract Code Section 20103.8(d), determination of apparent lowest bidder will be based upon an evaluation of the Base Bid and Bid Alternates in accordance with a process that prevents any information that would identify any of the bidders or proposed subcontractors or suppliers, or which bid belongs to which bidder, from being revealed to the District bid evaluation team before the ranking of all bidders from lowest to highest has been determined.

At the time the Bids are due, the evaluation team will convene behind closed doors. A proctor will monitor the room and will take custody of all cell phones, computers and other electronic devices while the evaluation team is in the room. In a separate room, the District’s Purchasing Agent will publicly announce the base bid price and price of each alternate upon receipt and opening of the Bids. The District’s Purchasing Agent will record pricing information on a summary sheet identifying the bidders by letter, e.g., “Bidder A”, “Bidder B”, etc. This summary sheet will then be provided to the proctor to deliver to the evaluation team making the decision concerning alternates to be accepted.

District staff will NOT reveal to the District evaluation team which Bid belongs to which Bidder until after the evaluation team has selected the Bid Alternates to be used in determining the apparent low Bidder and until after the evaluation team has identified the apparent low Bidder using the Base Price and whatever Bid Alternates the evaluation team selects.

Upon the conclusion of the closed door evaluation, the evaluation team will deliver the executed summary sheet, with all selected Bid Items circled and tallied, back to the proctor for delivery to the District’s General Manager. Subsequently, District staff will transmit and post District’s Notice of Intent to Award. The Notice will be posted at the District Offices. The District will use reasonable efforts to deliver by facsimile and/or e-mail a copy of the Notice of Intent to Award to all Bidders who submitted Bids no later than the Business Day after issuance.

A site visit prior to bidding is not mandatory for bidders to be qualified to bid on the project. Prebid photos and videos of the Site of Work as described in the Contract Documents are available to download and view at the hyperlink below:

If bidders wish to attend a voluntary site visit, bidders shall contact the District’s Project Manager, Derek Chiu, at (510) 477- 7611 to schedule a site visit. Bidders shall contact the District’s Project Manager at least 72 business hours in advance. The site visits shall be conducted in the presence of the District’s Project Manager or their designee.

All bidders making a voluntary site visit shall comply with the current (as of the date of the site visit) Alameda County Health Order update regarding the use of face covering and the minimum six-foot physical distance from others. In addition, all bidders shall review, complete, and acknowledge the District’s COVID-19 Visitor Screening Questions and Guidelines, which will be made available to bidders upon scheduling the site visit appointment. The District may utilize a touchless thermometer to confirm bidders do not have a temperature of 100.4 degrees Fahrenheit or higher before allowing entry.

Under California Laws and Regulations, the District shall inform all prime contractors of public works, to the extent feasible of relevant public work requirements as listed in Section 00010 of the Contract Documents.

All bidders shall consider and incorporate measures to ensure compliance with all applicable state and county health orders, including but not limited to Alameda County Health Order No. 20-14a, as may be updated from time to time (County Health Order), and the Construction Project Safety Protocols in Appendix B to the County Health Order. Among other things, compliance shall include but is not limited to the designation of a site-specific COVID-19 officer or supervisor, daily screening protocols, the implementation of social distancing, the provision of personal protective equipment (PPE) and requirement to wear face coverings, the implementation of cleaning and sanitizing requirements, and posting of signage and notices. For Large Construction Projects, compliance also includes but is not limited to preparation of a new or updated Site-Specific Health and Safety Plan and designation of a site-specific COVID-19 Third-Party Jobsite Safety Accountability Supervisor.

Copies of the Contract Documents are available for public inspection in the District’s website: https://unionsanitary.ca.gov/about-us/usd-construction-projects/projects-out-to-bid.. A paper copy of the Contract Documents, including half size drawings, may be purchased at the District Office for a non-refundable $75 charge, which includes the appropriate State sales tax and UPS Ground shipping costs. Bidders can provide their UPS or Fed Ex account number for any overnight shipping but the charge will not be discounted. Partial sets of Bid Documents are not available from the District. Bidders may pay for plans and specs by sending a check made out to Union Sanitary District, 5072 Benson Road, Union City, California 94587, or by going to our website www.unionsanitary.ca.gov for payment by VISA or MASTERCARD credit card.

All Bidders can provide their UPS or Fed Ex account number for any overnight shipping but the charge will not be discounted. However, all bidders submitting a bid must purchase and receive a paper copy of the Project Manual of Force Main Corrosion Repairs Project – Phase 4, Project No. 800-575 from the District prior to the bid opening date. All submitted bids must be on bid forms included in the purchased paper copy of the Project Manual or subsequent addenda. A bid submitted to the District by a bidder who has not purchased and received a paper copy of the Project Manual of Force Main Corrosion Repairs Project – Phase 4, Project No. 800-575, or submitted on bid forms not included in the purchased paper copy of the Project Manual or subsequent addenda shall be considered non-responsive and shall be rejected by the District.

Each bid must conform and be responsive to the invitation, the Plans and Specifications, and all documents comprising the Contract Documents. Each bid shall be presented under sealed cover and shall be accompanied by a certified check or bidder's bond, made payable to the District, in an amount not less than ten percent (10%) of the bid. The said check or bidder’s bond shall be given as a guarantee that the successful bidder will execute the contract in conformity with the form of agreement contained within the contract documents, and will furnish bonds and insurance policies as specified within ten (10) days after notification of the award of the Contract to the successful bidder.

Cost for work described in each addenda issued during the time of bidding shall be included in the Bid and the addenda shall become a part of the Contract documents.

Bidders shall develop and submit bids at their own expense. The District will not reimburse any costs associated with the development and submittal of any and all Bids.

The District reserves the sole right to reject any and all bids and to waive any informality in a bid.

No bidder may withdraw its bid for a period of one hundred twenty (120) days after the date set for the opening thereof.

At the successful Contractor's option, securities may be substituted for the required retention, in accordance with the provisions of Section 22300 of the State of California Public Contract Code.

In accordance with the provisions of California Public Contract Code Section 3300, the District has determined that the Contractor shall possess, as a minimum, a valid Class A License. In accordance with the provisions of California Business and Professions Code Section 7028.15, a bid submitted to the District by a Contractor who is not licensed in accordance with Chapter 9 of the California Business and Professions Code shall be considered non-responsive and shall be rejected by the District.

BID PROTEST: Any Bid protest must be submitted in writing to the Project Manager at the District Office located at 5072 Benson Road, Union City, California 94587 before 4:30 p.m. of the fifth Business Day following transmission and posting of the District’s Notice of Intent to Award. The notice will be posted at the District Offices. The District will use reasonable efforts to deliver by facsimile and/or e-mail a copy of the Notice of Intent to Award to all Bidders who submitted Bids no later than the Business Day after issuance, although any delay or failure to do so will not extend the Bid protest deadline described above.
