In order to provide Clinton Township with contractors and subcontractors who will carry out the work in a timely and satisfactory manner, the contractor must meet all applicable qualification requirements noted in Township Ordinance No. 413, Part I. All responsive bids must include a completed, executed and notarized “Contractor Responsibility Certificate”. The qualifications for the contractor will be reviewed on the basis of the proposed bidder’s past performance on work of a similar nature for Clinton Township and other owners. Provisions for this qualification procedure will be included in the bid documents.

PLANS AND SPECIFICATIONS
Plans and specifications must be obtained through BidNet, formerly the Michigan Intergovernmental Trade Network (MITN), at https://www.bidnetdirect.com/mitn, after 3:00 P.M. on Tuesday, February 11, 2020, and will be subject to Clinton Township Community Development Block Grant requirements. BID SECURITY
Bids must be submitted on the forms furnished by the Township Clerk or the Township Engineers in a sealed envelope marked:
BID FOR
NORMANDY PARK PAVING IMPROVEMENTS
A certified check, bank draft, or satisfactory bid bond, executed by the bidder and a surety company, payable to Clinton Township, in an amount at least equal to five percent (5%) of the bid amount, shall be submitted with each bid.
BONDS AND INSURANCE
The accepted bidder shall be required to furnish a satisfactory Performance Bond, and Labor and Material Bond in the amount of 100% of the Contract Price, and Maintenance and Guarantee Bond of 100% for two years of the Final Contract Price. The cost of the bonds will be paid by the accepted bidder.
WITHDRAWAL OF BIDS
No Bid may be withdrawn for a period of sixty (60) calendar days after receipt of bids.
AWARD OF CONTRACT
The Charter Township of Clinton reserves the right to accept or reject any or all bids, to award the agreement to other than the low proposal, to negotiate the terms and conditions of all and any part of the bids, to waive irregularities and/or formalities, and in general to make award in the manner as determined to be in the Township’s best interest and its sole discretion.
Each bidder agrees to waive any claim it has or may have against the owner, engineer, and their respective employees, arising out of or in connection with the administration, evaluation, or recommendation of any bid.
STATE AND FEDERAL REQUIREMENTS
Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this project, and that the contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin, in accordance with Executive Order 11246 Equal Employment Opportunity and Notice of Requirement for Affirmative Action to ensure Equal Employment Opportunity, and that the contractor will comply with Section 3 of the Housing and Urban Development Act of 1968, as amended.
The Contractor and sub-contractors must comply with Davis Bacon Act July 2nd, 1964 (Title 40§ 276A). The Equal Employment Opportunity Act September 28, 1965 No. 11246, all United States Department of Labor Regulations and standards Title 29, 1,3 and 5, and Title 18, U.S. C., Section 874 known as “Anti-Kickback Act” and the Federal Occupational Safety and Health Act of 1970.
The project shall commence immediately following a notice to proceed per these contract documents. This project shall be substantially completed within (60) days of said time.
