The City of Rochester will only receive hard copies of sealed bids until 2:00 pm local time on Wednesday, July 12, 2017, at the offices of the City Clerk, City of Rochester, 400 Sixth Street, Rochester, Michigan 48307, at which time and place all bids will be publicly opened and read aloud.

PRE-BID MEETING
A mandatory pre-bid meeting will be held at Rochester City Hall, City of Rochester, 400 Sixth Street, Rochester, Michigan 48307, at 3:00 pm., local time on Tuesday, June 20, 2017. Prospective Bidders shall attend and participate in the pre-bid meeting.
PLANS AND SPECIFICATIONS
Plans and Specifications are on file and copies may be secured on or after Monday, June 12, 2017 after 1:00 p.m., at the offices of Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315 Phone (586) 726-1234. A fee of Fifty ($50.00), payable to Anderson, Eckstein and Westrick, Inc., will be required for each set of Plans and Specifications and will not be refunded. A mailing fee of Fifteen Dollars ($15.00) to cover postage and handling will be charged to anyone wishing to receive the specifications via United Parcel Services.
Plans and specifications may be obtained by registering with the Michigan Inter-Governmental Trade Network (MITN) at www.govbids.com/scripts/mitn/Public/home1.asp. The plans and specifications will be available for download on Monday, June 12, 2017 after 1:00pm.

Bidders wishing to download the Plans and Specifications at NO COST, through MITN or AEW, may do so by registering as a planholder with AEW over the phone at (586) 726-1234.
All bids shall be opened publicly at the date and time specified. Each bid shall be recorded together with the name of the bidder. Bids shall be in accordance with the requirements of this notice in order to be deemed “responsive.” Bids will be rejected unless made on the forms as included with the bidding documents.
Bids are to be submitted in a sealed envelope, plainly marked “BID – CITY OF ROCHESTER, 2017 STATE REVOLVING FUND (SRF) SANITARY SEWER REHABILITATION PROGRAM, CONTRACT 1” and received by the City Clerk on or before the time and date given above.
BID SECURITY
A certified check, bank draft, or satisfactory bid bond, executed by the bidder and a surety company on the form provided, payable to the City of Rochester, in an amount equal to five percent (5%) of the bid amount, shall be submitted with each bid.
WITHDRAWAL OF BIDS
No bid may be withdrawn for a period of one hundred eighty (180) calendar days after receipt of bids. This time frame may be adjusted through mutual agreement between the Owner and the Contractor.
AWARD OF CONTRACT
The City of Rochester reserves the right to reject any or all bids and/or to waive any irregularities in bidding. The successful bidder will be required to furnish satisfactory performance, payment, maintenance and guarantee bonds and insurance certificates.
DAVIS-BACON/PREVAILING FEDERAL WAGE RATES
P.L. 111-88 requires compliance with the Davis Bacon Act and adherence to the current U.S. Department of Labor Wage Decision. Attention is called to the fact the not less than the minimum salaries and wages as set forth in the Contract Documents (see Wage Decision include herein) must be paid on this project. The Wage Decision, including modifications, must be posted by the Contractor on the job site. A copy of the Federal Labor Standards Provisions is included and is hereby a part of this Contract.
DEBARMENT CERTIFICATION
Bidder must provide a completed Certification Regarding Debarment, Suspension, and Other Responsibility Matters Form with its bid or proposal package to the Owner.
DISADVANTAGED BUSINESS ENTERPRISES (DBE)
Prime contractors bidding on this project must follow, document, and maintain documentation of their Good Faith Efforts to ensure that Disadvantaged Business Enterprises (DBEs) have the opportunity to participate in the project by increasing DBE awareness of procurement efforts and outreach. Bidders must comply with the DBE Good Faith Efforts outlined in this Contract and submit a Good Faith Efforts Worksheet for each area of work, both major and minor, to be subcontracted with its bid to the Owner.

BUY AMERICAN AGREEMENT
The Contractor acknowledges to and for the benefit of the city of Rochester (“Purchaser”) and the Michigan Department of Environmental Quality (the “State”) that it understands the goods and services under this Agreement are being funded with monies made available by the State Revolving Fund and/or the Drinking Water Revolving Fund and such law contains provisions commonly known as “American Iron and Steel (AIS);” that requires all iron and steel products used in the project be produced in the United States (“AIS Requirements”) including iron and steel provided by the Contractor pursuant to this Agreement. The Contractor hereby represents and warrants to and for the benefit of the Purchaser and the State that (a) the Contractor has reviewed and understands the AIS Requirements, (b) all iron and steel used in the project will be and/or have been produced in the United States in a manner that complies with the AIS Requirements, unless a waiver of the requirements is approved or the State made the determination in writing that the AIS Requirements do not apply to the project, and (c) the Contractor will provide any further verified information, certification or assurance of compliance with this paragraph, or information necessary to support a waiver of the AIS requirements, as may be requested by the Purchaser. Notwithstanding any other provision of this Agreement, any failure to comply with this paragraph by the Contractor shall permit the Purchaser or State to recover as damages against the Contractor any loss, expense or cost (including without limitation attorney’s fees) incurred by the Purchaser or State resulting from any such failure (including without limitation any impairment or loss of funding, whether in whole or in part, from the State or any damages owed to the State by the Purchaser). While the Contractor has no direct contractual privity with the State, as a lender to the Purchaser for the funding of its project, the Purchaser and the Contractor agree that the State is a third-party beneficiary and neither this paragraph (nor any other provision of this Agreement necessary to give this paragraph force or effect) shall be amended or waived without the prior written consent of the State.
