NOTICE TO BIDDERS MORRIS COUNTY MUNICIPAL UTILITIES AUTHORITY MORRIS COUNTY, NEW JERSEY SEALED BIDS FOR OPERATING THE TWO MORRIS COUNTY SOLID WASTE TRANSFER STATIONS, LOCATED IN PARSIPPANY-TROY HILLS TOWNSHIP AND MOUNT OLIVE TOWNSHIP, INCLUDING PROVIDING TRANSPORTATION VIA TRANSFER TRAILERS AND ALTERNATIVES FOR INTERMODAL RAIL CONTAINERS AND DISPOSAL OF ALL SOLID WASTE RECEIVED AT THE TRANSFER STATIONS The work under this Bid shall include furnishing all labor, equipment and materials necessary to provide services as more particularly described in the Bid Documents. Sealed Bids will be received by the Morris County Municipal Utilities Authority (“MCMUA”) on Thursday the 13th, of September 2012 at 2:00 p.m. prevailing time at the Morris County Municipal Utilities Authority office located on the third floor at 300 Mendham Road, Morris Township, New Jersey and at that time and place will be publicly opened and read aloud for the “Operation of the Two Morris County Solid Waste Transfer Stations Including Transportation Via Transfer Trailers and Alternatives for Intermodal Rail Containers and Disposal of All Solid Waste Received at the Transfer Stations.” The Bids shall be in accordance with the Bid Documents on file with the Morris County Municipal Utilities Authority. No bids will be received after the time and date specified, and no bids will be received by mail. Bids shall be hand delivered or received by courier service (including but not limited to Fed Ex, UPS, DHL, etc.) (date and time recorded). The MCMUA is seeking Bids for combined operation, transportation and disposal services only. The MCMUA owns two transfer stations. They are located in Mt. Olive Township, New Jersey and Parsippany-Troy Hills, New Jersey. The transfer station situated in Parsippany-Troy Hills has a not-to-exceed permitted daily capacity of 1,380 tons-per-day with a not-to-exceed weekly permitted capacity of 6,900 tons-per-week. The transfer station situated in Mt. Olive Township has a not-to-exceed permitted capacity of 975 tons-per-day. The combined operation, transportation and disposal services involves providing all labor and equipment and materials to operate the two solid waste transfer stations owned by the MCMUA, including providing all labor, equipment and materials to transport and dispose of all Solid Waste from the two transfer stations. The operation of the two transfer stations and transportation and disposal of Solid Waste from these facilities must be performed in accordance with the New Jersey Department of Environmental Protection approved Solid Waste Facility permits, the Morris County Solid Waste Management Plan, as well as all applicable federal, state and local laws and regulations. The Bid Documents contain three (3) options on which to bid. Bidders may, but are not required to bid on each option. The MCMUA reserves the right to select the option that is in the best interest of the MCMUA and award a contract to the lowest responsible bidder for that option. The MCMUA will select only one of the following three (3) options that are contained in the Bid Documents and are summarized as follows: ALTERNATE A Combined operation of the two transfer stations, transportation of solid waste to final disposal facilities via over-the-road transfer trailers, and disposal of solid waste from the MCMUA’s two transfer stations for a period of four (4) years, with a single one-year renewal extension period. The determination of whether to authorize the one-year renewal extension period is within the sole discretion of the MCMUA. Under Alternate A there will be no opportunity to modify either transfer station for the use of Intermodal Container loading. ALTERNATE B Combined operation of the two transfer stations, transportation of solid waste from the transfer station situated in Parsippany-Troy Hills to an Intermodal Facility that will facilitate and transport Intermodal Containers by rail to final disposal facilities, transportation of solid waste from the transfer station situated in Mt. Olive Township to final disposal facilities via over-the-road transfer trailers, and disposal of solid waste from the MCMUA’s two transfer stations for a period of four (4) years, with a single one-year renewal extension period. The determination of whether to authorize the one-year renewal extension period is within the sole discretion of the MCMUA. This alternate would require the successful bidder to modify the design and operations at the transfer station situated in Parsippany-Troy Hills for the loading and transportation of solid waste by intermodal rail containers and obtain all necessary approvals at its own cost. Transportation of solid waste to final disposal facilities from the transfer station situated in Parsippany-Troy Hills would be via over-the-road transfer trailers until such time that the successful bidder modifies the design and operations of the transfer station situated in Parsippany-Troy Hills and obtains all necessary approvals for the transportation of solid waste to final disposal facilities by intermodal rail containers. Under Alternate B there will be no opportunity to modify the Mt. Olive transfer station for the use of intermodal container loading. ALTERNATE C Combined operation of the two transfers stations, transportation of solid waste from the two transfer stations to an Intermodal Facility that will facilitate and transport Intermodal Containers by rail to the final disposal facilities, and the disposal of solid waste from the MCMUA’s two transfer stations for a period of four (4) years, with a single one-year renewal extension period. The determination of whether to authorize the one-year renewal extension period is within the sole discretion of the MCMUA. This alternate would require the successful bidder to modify the design and operations at the two transfer stations situated in Parsippany-Troy Hills and Mt. Olive Township for the transportation of solid waste by intermodal rail containers and obtain all necessary approvals at it own cost. Transportation of solid waste from the transfer stations situated in Parsippany-Troy Hills and Mt. Olive Township would be via over-the-road transfer trailers to final disposal facilities, until such time that the successful bidder modifies the design and operations of the transfer stations situated in Parsippany-Troy Hills and Mt. Olive Township and obtains all necessary approvals for the transportation of solid waste to final disposal facilities by intermodal rail containers. Bidders may “team” with other firms to submit bids for Contract Services, however, the Authority will contract only with one entity and that entity will have full responsibility to cause the Contract Services to be provided in accordance with such contract. Bids must be in writing on forms furnished and accompanied by a certified check or bid bond payable to the Morris County Municipal Utilities Authority for an amount not less than ten percent (10%) of the base bid for each of the alternates on which a bid is submitted, but in no case shall the amount exceed $20,000.00. Each Bidder must submit with the bid a Non-Collusion Affidavit in accordance with the Bid Documents. Each bidder must submit, with its Bid, a signed Equipment Certification stating that it owns, leases or controls all the necessary equipment required to accomplish the Work as described and required in the Bid Documents. Should the Bidder not be the actual owner or lessee of such equipment required, its Certification shall state the source from which the equipment will be obtained, and in addition, shall be accompanied by a signed Certification from the owner or person in control of the equipment required for that portion of the Contract for which it is necessary. A qualified bidder and each subcontractor, as applicable, must be the current holder of valid disposal permits, a valid Certificate of Public Convenience and Necessity in accordance with N.J.S.A. 48:13A-6, and a current A-901 license in accordance with N.J.S.A. 13:1E-127 et seq. or be grandfathered according to law in the State of New Jersey as of the date the bid is submitted to the MCMUA. This provision shall apply only with respect to solid waste services provided in the State of New Jersey. Each Bid shall further be accompanied by a Consent of Surety for the furnishing of a Performance and Payment Bond as described in the Bid Documents for each of the alternates on which a bid is submitted. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31, et seq. (N.J.A.C. 17:27) (Equal Employment Opportunity), 42 U.S.C. § 12101, et seq. (Americans with Disabilities Act), P.L. 2004, c.57 (Business Registration), P.L. 2009 c.88 (N.J.S.A. 34:11-68) (Wage Records), and P.L. 1977 C.33 (Corporation and/or Partnership Owner Information) and any subsequent amendments thereto. Bid Documents may be obtained on or after Monday, July 9, 2012 at the offices of the Morris County Municipal Utilities Authority, during regular business hours between 8:30 a.m. and 4:30 p.m. or by submission to the MCMUA of a written request on or after Monday, July 9, 2012 for postal or overnight delivery to Bidder. Bid Documents will be made available upon payment of a non-refundable fee of $200.00 for each complete set plus any postal delivery charges. A tour of the Transfer Station Facilities for all prospective bidders shall be held on Tuesday, July 24, 2012. All bidders are strongly encouraged to attend this tour. The location and time of the tour are set forth in the Bid Documents. The MCMUA reserves the right to reject any or all bids, and reserves the right to waive any informality in the bids and to accept the bid which, in its judgment, best serves the interest of the Authority, as authorized by law. Prospective bidders are cautioned not to rely solely on this Notice to Bidders in preparing their bids, but to read the Bid Documents in their entirety and comply with all bidding requirements set forth therein.
