NOTICE OF REQUEST FOR PROPOSALS
GENERAL COUNSEL, BOND COUNSEL, AND SPECIAL ENERGY COUNSEL SERVICES
PUBLIC NOTICE
NOTICE IS HEREBY GIVEN that the Morris County Improvement Authority (the “Authority”) is soliciting proposals from qualified professionals to provide General Counsel, Bond Counsel, and Special Energy Counsel Services (the “Counsel Services”).
Sealed proposals for the Counsel Services (“Proposals”) will be received by Anthony Aponte, Purchasing Agent for the Authority, at 10 Court Street, Suite 517, Purchasing Division, Morristown, New Jersey 07963 by no later than 4:00 P.M. Eastern Standard Time on March 2nd, 2023.
The Request for Proposal (“RFP”) documents will become available on February 16th, 2023 at 10:00 a.m., Eastern Standard Time. RFP documents may be obtained by interested potential Respondents via written email request to Mr. Anthony Aponte, QPA, Purchasing Agent for the Authority at aaponte@co.morris.nj.us. as well as being available for downloading from http://www.morriscountybidsystem.com/. The Authority assumes no responsibility for potential respondents that fail to obtain the proper documentation as instructed herein.
Proposals and all information required to be submitted pursuant to the RFP shall be prepared at the sole cost and expense of each individual or firm responding to this RFP (the “Respondent”). There shall be no claims whatsoever against the Authority, its officers, officials, or employees for reimbursement for the payment of costs or expenses incurred in preparing and submitting a Proposal or for participating in this procurement.
To the extent the Authority, in its sole discretion, determines to amend, modify, supplement, revoke or alter any other material term or condition of the RFP, including, without limitation, the procurement process or the criteria for qualification or award, which rights are hereby expressly reserved to the Authority, the Authority will make all commercially reasonable efforts to communicate any such change to each potential Respondent prior to the due date of the RFP through e-mail or other notification distributed to the contact person(s) identified to the Authority.
By submitting a Proposal, each such Respondent, without any other act, acknowledges and agrees to comply with each of the terms and conditions of the RFP, and further agrees to abide by, without protest or cause of action, any determination made by the Authority hereunder, including the qualification and award determinations made hereunder.
Proposals for the Counsel Services will be received by hand delivery, mail, or delivery service in accordance with the instructions provided herein up until the date and time indicated above. The Authority will not be responsible for packages not arriving at the time and place designated, irrespective of the date and time the package was mailed, posted, or left with a delivery service. Respondent assumes any and all risk of late delivery of its Proposal. Proposals not received on time will be returned to Respondent unopened.
All questions regarding the RFP must be submitted via email request to Mr. Anthony Aponte, QPA, Purchasing Agent for the Authority at aaponte@co.morris.nj.us with a copy to Matthew D. Jessup, Esq. at mjessup@msbnj.com, prior to February 22nd, 2023 at 3:00 p.m. Responses will be provided no later than February 25th, 2023.
Respondents and their subcontractors must at all times comply with all applicable obligations pursuant to the New Jersey Campaign Contributions and Expenditure Reporting Act, N.J.S.A. 19:44A-1 et seq., and any local or municipal restrictions adopted in accordance with said Act. Respondents are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq.
The Authority will award a contract for the Counsel Services or reject all Proposals within sixty (60) days after receipt of the Proposals unless otherwise agreed by the parties.
Proposals may not be modified after submittal. The Authority reserves the right to reject any or all Proposals or to waive any informalities in any Proposal received and to accept the Proposal which in its judgment will best serve the interest of the Authority.
Any inconsistency between this notice and the RFP shall be governed by the terms of the RFP.
