Notice is hereby given that the City of Batavia will accept bids for the Bank Street and Alva Place Streetscape Enhancements Project, City of Batavia, Genesee County. The project will include, but not be limited to milling and resurfacing Banks Street (Main Street to Washington Avenue) and the entrance throat to Alva Place. The milled areas of the project include spot pavement reconstruction as needed; curb bump outs; some curb resetting; sidewalk infrastructure upgrades to meet the requirements of the Americans with Disabilities Act (ADA); resetting of drainage structures; installation of new drainage structures; driveway apron replacement; a dedicated bike lane; a shared bike line; decorative crosswalks, and Rectangular Rapid Flashing Beacons (RRFBs). All work will be in accordance with the Contract Drawings and Specifications and as directed by Engineer. This project is a Locally Administered Federal Aid Project. The DBE goal for this project is 6%, there are no M/WBE goals. No residential or geographical restrictions will be in effect for this project. Applicable Federal requirements take precedence over State and local requirements unless state and local requirements are deemed to be more stringent. Services will be required to obtain a hard copy of the Contract Documents. The Digital Download Fee for the Contract Documents will be Sixty Dollars ($60) USB with an electronic version of the Contract Documents for the above contract. Cash payments will not be accepted. The payment includes shipping of the hard copies to anywhere in the Continental United States. By submission of the nonrefundable payment, bidder will be registered as an official plan holder. Only official plan holders are eligible to bid on the project. Subcontractors, suppliers, equipment vendors, etc., will also be to submit the non-refundable payment in order to receive the hard copies and electronic version of the Contract Documents. If bidders wish to purchase printed copies of the Contract Documents (beyond the Proposal Booklet), they may be obtained through Avalon. Only official plan holders will be allowed to obtain printed copies of the Contract Documents. Bidders acknowledge that they are responsible for review of all components of the Contract Documents, including all specification sections and drawings, regardless of how many drawings they print and in which format/size they are printed. Full-size drawings are on 22-inch by 34-inch paper. Bidders acknowledge they are responsible for properly scaling drawings if they are printed on any other size. Bids must be submitted on the form(s) furnished in the Proposal Booklet. The entire Proposal Booklet shall be submitted with the bid along with any other required forms outlined in the Contract Documents. Failure to submit a bid on the proposal form(s) furnished in the Proposal Booklet, will result in automatic disqualification of bid. Addendum pages, if issued, along with any other required forms outlined in the Contract Documents, shall be stapled to the original pages of the Proposal Booklet and submitted as part of the Bid. A bid security in the amount of 5% of the total bid made payable to the “City of Batavia” will be required and is subject to the conditions provided in the Instructions to Bidders. Failure to submit a bid bond or certified check with bid will result in automatic disqualification of bid. If, upon acceptance of his bid, a bidder fails to enter into a Contract with the City of Batavia, the bid security shall be forfeited to and become the property of the City. No bidder may withdraw his Bid within forty-five (45) calendar days after the actual date of the opening thereof. The successful bidder will be required to furnish a performance bond and payment bond, each in an amount equal to 100 percent (100%) of the total Contract award amount. The City of Batavia is exempt from the payment of sales and compensating use taxes of the State of New York and of cities and counties on all materials, equipment, and supplies sold to the City of Batavia pursuant to this Contract. Also exempt from such taxes are purchases by the CONTRACTOR and his Subcontractors of materials, equipment, and supplies to be sold to the City of Batavia pursuant to this Contract, including tangible personal property to be incorporated in any structure, building, or other real property forming part of the Project. These taxes are not to be included in the Bid. Each bidder's attention is called to the General Municipal Law, which requires a Bidder's Certificate of Non-Collusion. Copies of such certifications are part of the Proposal Form, and unless completed with the Bid, will not be accepted. Minority and Women Owned Business Enterprises and Section 3 firms are encouraged to submit Bids on this project. Made in America laws are applicable to federal financial assistance (such as grants). In accordance with the policy of the United States Government, consistent with applicable law, use, terms and conditions of Federal financial assistance awards and federal procurements, recipients must maximize the use of goods, products, and materials produced in, and services offered, in the United States. Whenever possible, the recipient shall procure goods, products, materials, and services from sources that will help American businesses compete in strategic industries and help America’s workers thrive. See the January 25, 2021 Executive Order on Ensuring the Future is Made in All of America by All of America’s Workers for more information. “Made in America Laws” means all statutes, regulations, rules, and Executive Orders relating to Federal financial assistance awards or Federal procurement, including those that refer to “Buy America” or “Buy American,” that require, or provide a preference for, the purchase or acquisition of goods, products, or materials produced in the United States, including iron, steel, and manufactured goods offered in the United States. Made in America Laws include laws requiring domestic preference for maritime transport, including the Merchant Marine Act of 1920 (Public Law 66-261), also known as the Jones Act.
The City of Batavia reserves the right to waive any informalities in the Bid and to reject any or all Bids. No questions or inquiries regarding this bid will be accepted within three (3) business days prior to the bid opening. Addenda will be emailed from TYLin to Bidders listed on the official Plan Holders List. An emailed response from the Bidder, to the Addendum sent by TYLin, will act as proof that the Bidder received the Addendum. In addition to an emailed response, Bidders must acknowledge receipt of all Addenda by signing and dating each Addendum on signed Bid Form. Failure of any Bidder to receive any such Addendum or interpretation shall not relieve such Bidder from any obligation under this Bid submittal. All Addenda so issued shall become part of the Contract Documents.

Bids will be received at the above address until 2:00 PM on FEBRUARY 26, 2025, at which time they will be publicly opened and read aloud. The official time for the receipt of bids will be the time shown on the time stamp located in the City of Batavia. The Bidder to whom the Contract is awarded will be required to furnish Performance, Payment and Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% of the accepted bid. The successful Bidder and all subcontractors shall submit form CCA-2 prior to being awarded a contract. If the successful Bidder does not currently have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction for completion online at https://osc.state.ny.us/venrep/form_cca2.htm
The successful Bidder will be required to comply with all provisions of the Federal Government Equal Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968 and published in the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will be required to pay prevailing wage rates on this contract. The Owner further reserves its right to disqualify Bidders for any material failure to comply with the “INSTRUCTION TO BIDDERS”.
