The City of Yonkers (the “City”) is requesting proposals from qualified individuals or entities with the intent of entering into a multi-year agreement for the operation of a revenue generating restaurant or other food services business in the space located on the second floor of the Yonkers Recreation Pier (the “Yonkers Pier” ) and the rehabilitation and maintenance of same, as described more fully in this RFP.
The City-owned Yonkers Pier is located in southwest Yonkers on the Hudson River in the City’s downtown waterfront at 99 Main Street, Yonkers, New York and is designated on the Official Tax Map of the City as Section 2, Block 2600, Lot 24.The Yonkers Pier is the only turn-of-the 20th century pier still in use on the Hudson River. The restored first-floor pavilion of the Yonkers Pier provides public recreation space and access to the waterfront. The Yonkers Pier has views of the George Washington Bridge and the New York City skyline to the south, the Palisades to the west, and the Governor Mario M. Cuomo Bridge to the north.
In 2004, the City Board of Parks, Recreation and Conservation approved a license and concession agreement with the City of Yonkers Industrial Development Agency (“YIDA”) for the purpose of allowing for improvements to the Yonkers Pier and the service of food and beverages at the Yonkers Pier. The City, thought its Parks Department, and the YIDA entered into a City Pier Pavilion Master Agreement dated March 24, 2005, which, among other things, facilitated the renovation of the approximately 7,000 square foot second floor of the Yonkers Pier and, through various agreements, and the operation of a restaurant in this space . Thereafter, a sublicense was entered into with the existing restaurant operating on the second floor of the Yonkers Pier, Xavier X2O; this sublicense t expires on September 30, 2024. The City’s objective through this RFP is to identity a business to operate restaurant or food services business at this location under a new License.
Pursuant to an Agreement with the City, as described more fully herein, it is anticipated that the successful proposer will be granted:
- the right to use the following portion of the Yonkers Pier for the purpose of operating a restaurant or food services business (the “Business”):
- the second floor measuring approximately 7,820 square feet; and
- The small storage closet on the first floor adjacent to the public restrooms, which includes the hot water heater for the restaurant;
- the right to enter and access the following portion of the Yonkers Pier for the purpose of conducting certain activities ancillary to the operation of the Business and maintaining the Yonkers Pier, such as pre-approved special events (the “Ancillary Space”):
- the Pier/ wharf area is approximately 10,790 square feet;
- the surrounding property on the Yonkers Pier including the grounds, paths, walkways, paved areas, facilities, structures, equipment, and other infrastructure at the Site and other restorations, renovations and improvements to the Site”
The successful proposer acknowledges and agrees that park patrons will have free and open access to the Ancillary Space.
The successful proposer will be restricted from vehicular/truck access to the esplanade/driveway for deliveries, trash pick-up, etc. All must be accessed from the curbside.
The successful proposer agrees to allow the City unrestricted access to the roof.
The successful proposer will, at its sole cost and expense, and in accordance with standard industry practices, the terms of this RFP and the terms specified in Schedule “B,” shall
- rehabilitate, repair, renovate and maintain in good operation condition the portion of the Yonkers Pier authorized to be used for the purpose of operating a Business and all other fixtures, improvements and property described above in the subsection 1.4 of Section III (the “Work”);
- be responsible for obtaining and/or acquiring all supplies, materials, accessories and equipment (and permits or other approvals, as appropriate) that are necessary to perform those responsibilities and operate the Business; and
- be responsible for maintaining a security alarm/system; and
- be responsible for maintain the grease trap at the first floor utility room; and
- be responsible for all parking and valet service related to the Business; and
- be responsible for all utilities/electricity
The City anticipates entering into an agreement with the selected respondent to allow for the performance of the services on the terms described in this RFP (the “Agreement”). Subject to negotiation and additional terms and conditions, it is anticipated that the initial term of the Agreement will be ten (10) years. Thereafter, the Agreement may be renewed by mutual agreement of the parties, subject to all necessary legal approvals.
Any Agreement must be consistent with the Yonkers Pier’s status as parkland. In connection therewith, the Agreement may be in the form of a license and may contain terms related to revocation, exclusivity/access restrictions, and the service of a public benefit consistent with the Yonkers Pier’s status as parkland.
A Yonkers Pier Sample License Agreement is attached as a schedule to this RFP. This document sets forth the anticipated terms of the Agreement, however, the attached Yonkers Pier Sample License Agreement is merely a draft/sample and is subject to modification and negotiation.
