Specifications include, but are not limited to: 1. (Full Title Search Only). The Contractor shall provide all of the technical and professional services and materials necessary and incidental to accomplishing the following: a. Conducting, reporting, certifying in writing and delivering in the format prescribed by the City for filing with the Court Clerk as a part of the foreclosure proceeding judgment roll two copies of all title searches requested by the City, together with two sets of business-sized mailing envelopes and a separate set of adhesive labels for affixation to the Tax Enforcement Statements addressed to all persons required by Section C19-33 of the Code of the City of Saratoga to be given personal notice by certified and regular mail of the “In Rem” delinquent tax foreclosure proceeding in connection with which said title search was made. All work shall conform to the requirements of the County and the State of New York for title companies to authorize title policies. b. A Title Search shall consist of conducting a sufficient search to determine the name(s) and address(es), recording and/or filing information, nature and, if applicable, dollar amount of the interest of (i) each owner and any other person, including but not limited to recorded mortgagee, lien holder or judgment creditor, whose right, title, or interest was a matter of public record as of the date the list of delinquent taxes was filed, which right, title or interest will be affected by the termination of the redemption period, and whose name and address are reasonably ascertainable from the public record, including the records in the offices of the Surrogate of the County of Saratoga, or from material submitted to the tax enforcing officer of the City of Saratoga regarding changes of address. c. The “public record” shall be deemed to consist of the books maintained by the recording officer of Saratoga County pursuant to section 315 of the Real Property Law, the books kept by the Clerk of the Saratoga County Surrogate's Court pursuant to section 2502 of the Surrogate's Court Procedure Act, the New York State Department of State, declaration of interests filed pursuant to Section C19-37 of the Code of the City of Saratoga which has not expired, the books of the enforcing officer of any other tax district having a right to enforce the payment of a tax imposed upon any of the parcels described in the list and the tax rolls in the possession of the enforcing officer of the City of Saratoga.
