Item 1. Rack Price is defined as follows: For 100% ULS DIESEL 15PPM FUEL, ULS DIESEL 15PPM WINTERIZED OR WITH COLD FLOW IMPROVER and ULS 15 PPM KEROSENE, the Rack Price shall be the ULS DIESEL, Syracuse, NY Index price in effect at the time the product is loaded onto the delivery vehicle. The Rack Price is subject to periodic escalations and de-escalations. For the purpose of bid comparisons, a date is listed for the Rack Price and the bidder shall enter the price that was in effect on the listed date on the bid form for Item 1. Item 2. Required Fees are defined as the fixed taxes and fees per gallon required to be charged based on Federal and State government statutes or regulations. For all purchases of fuel under this bid, the County of Cortland is exempt from paying the following taxes and they shall not be included in the price bid for fuel: · State and Local sales tax, · Petroleum Business tax, · Federal Gasoline Excise tax, · NYS Motor Fuel tax The Required Fees to be included for Item 2 is as follows: a. Federal LUST fee b. Federal Oil Spill Liability Trust Fund fee The price bid for Item 2 is a fixed charge per gallon that shall remain in effect for the life of the bid and shall not fluctuate (increase or decrease) with each order. Item 3. Delivery and Profit Markup is defined as the bidder’s charge per gallon for the following: · loading of fuel at the Terminal · ground transportation of the fuel from the Terminal to Cortland County Highway Dept. · unloading of fuel into the above-ground storage tank at Cortland County Highway Dept. · overhead and profit. The price bid for Item 3 is a fixed charge per gallon that shall remain in effect for the life of the bid and shall not fluctuate (increase or decrease) with each order. Item 4. Total Bid Price is defined as the sum of the prices quoted for Items 1 at the time an order is placed plus the sum of the fixed prices bid for Items 2 & 3, as defined in this section.
