The City of Jacksonville is requesting BIDS for Utility Cut Repairs FY22 Re-Bid located in Jacksonville, North Carolina:
Description: This is a Contract for utility cut repairs. Work to be performed under this Contract includes the repair of roadways, driveways
and sidewalks damaged during the repair of utilities for the City of Jacksonville. Work includes, but is not limited to, materials, equipment
and labor for repairing asphalt pavement and concrete structures such as driveways, curb and gutter, curb ramps and sidewalks.
Special Notes to potential bidders:
a. This will be a six (6) month contract.
b. The City will issue a written Work Directive to the Contractor listing the locations of the utility cuts within five (5) working days of the
Notice to Proceed Date. The Contractor shall complete the Work Directive within 6 months of the Notice to Proceed date. Once the Work
Directive is complete, the city may, with the Contractor’s approval, issue an additional Work Directive list.
c. The Contractor shall notify the Owner forty-eight (48) hours prior to beginning work or any halt to the work and upon completion. A halt
to the work is defined as no measureable progress toward completion of the Work Directive list for three (3) or more days. Measurable progress is
determined by COJ. If a halt to the work is necessary, the contractor must communicate with the COJ Inspector and Engineering department in
writing by email. If no work has been completed for three (3) or more days and no written communication by email to the Inspector or the
Engineering department has occurred, the City may collect liquidated damages at a rate of $250 per day and/or terminate the contract. Verbal
communications will not satisfy this requirement.
All bids are to be returned to Veronica Morphy by 3:00 PM EST on November 5, 2021
at the Engineering Division at Jacksonville City Hall located at 815 New Bridge Street, Jacksonville, NC 28540. There will not be a public bid opening.
The responsibility for submitting bids (including all documents requested herein) is solely and strictly that of the bidder. The CITY is not responsible for delays in the
delivery of the mail or delays caused by any other occurrence. Bids received after the time for closing will not be considered.
The CONTRACT DOCUMENTS may be examined and/or obtained at the Engineering Division at Jacksonville City Hall located at 815 New Bridge Street, Jacksonville,
NC 28540. Persons requesting shipment of documents shall bear the additional, non-refundable cost of shipment.
The Jacksonville City Council reserves the right to waive any informalities, to reject any or all bids and to accept that Bid or Bids which appear to be in the Owner's best interest.
NO WEAPONS: There shall be no weapons or guns allowed on City property or private property you are contracted to work at or on.
BID BOND: NOT REQUIRED
LICENSURE: BIDDERS must be properly licensed under Chapter 87 of the North Carolina General Statutes.
E-VERIFY COMPLIANCE PROVISION: North Carolina General Statute §143-133.3 prohibits the
City from entering into contracts with contractors and subcontractors who have not complied with
the requirement of Article 2 of Chapter 64 of the North Carolina General Statutes. Contactor shall
comply with the requirements of Article 2 of Chapter 64 of the North Carolina General
Statutes. Further, if contractor utilizes a subcontractor, contractor shall require the subcontractor
to comply with the requirements of Article 2 of Chapter 64 of the North Carolina General Statutes.
WITHDRAWAL OF BID: No Bid may be withdrawn within sixty (60) days after the date of Bid
Opening.

MINORITY BUSINESS PARTICIPATION: The CITY has established a verifiable goal of ten percent
(10%) for minority participation on City building construction and repair projects. In order to
foster participation by minority businesses to conduct business with the City and in accordance
with NCGS 143-131(b) and Resolution 1994-08, the City of Jacksonville will solicit minority
participation in all construction related contracts. Bidders shall undertake good faith efforts to
recruit minority business participation on this project. The minority business must be registered
with the North Carolina State Department of Administration, Office of Historically Underutilized
Businesses. BIDDER must complete and submit either Affidavit A or B with their Bid proposal.
BONDS: The successful Bidder, upon award of contract, shall furnish a Payment Bond for 100% of
the project price; and a Performance Bond for 100% of the project price. A Surety licensed to do
business in the State of North Carolina must issue the Payment Bond and the Performance Bond.
The Bonds will be executed by the signing of a Power of Attorney by the Surety and will list the
Resident North Carolina Agent.
CONTROLLING LAW: Any agreement, contract, or purchase order resulting from this invitation,
request for bid, quote, or request for proposal shall be governed by the laws of the State of North
Carolina.
