The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.**
The 28th Contracting Squadron, Ellsworth AFB, South Dakota, has issued this solicitation, FA469023Q0060, to compete and award a single Firm Fixed Price contract using FAR Part 13 procedures for the supply of two Brand Name Cummins/Onan Emergency Generators (See Attachment 2: Salient Characteristics).
This will be a 100% Small Business set-aside solicited under the North American Industry Classification System (NAICS) code 335312 with a size standard of 1,250 employees. To be eligible to compete for Small Business set-aside awards, vendors must be certified in accordance with current Small Business Administration (SBA) regulations.

All interested and responsible entities are invited to submit a quote that will be considered by the 28th Contracting Office at Ellsworth AFB, South Dakota. The award will be based on the following criteria:
- The Government will award a contract resulting from this solicitation to a responsible offeror whose proposal conforms to the solicitation. The following factors shall be used to evaluate offers: Price and Non-Price(technical).
- Step 1: Evaluate all quotations for responsiveness.
- Step 2: Rank all responsive quotations based upon Vendor's Total Evaluated Price (TEP). TEP is defined as the total amount of CLIN 0001 and CLIN 0002.
- Step 3: Evaluate lowest price offeror's technical acceptability. This will be accomplished by reviewing the offeror's technical literature provided against the salient characteristics. If technically acceptable, move to step 4. If not technically acceptable, evaluate the next lowest priced Vendor's.
- Continue evaluating technical acceptability until a rating of technically acceptable is achieved or all proposals are evaluated.
- Step 4: Make a best value decision based on technical and a determination of price fair and reasonable.
- The Government intends to evaluate quotes and award a contract without Interchanges with quoters. However, the Government may conduct Interchanges with one, some, none or all quoters at its discretion.
Small Business contractors submitting a quote must have and list within the quote the vendors assigned Cage Code and be registered and Active in the System for Award Management (SAM) at www.sam.gov to receive an award for this procurement.
