DFARS 252.204 7012 is a regulatory requirement that applies to all acquisitions within the Department of Defense (DoD),with the exception of Commercial Off the Shelf (COTS) items. It mandates that contractors establish controls to safeguard sensitive information and report any cyber incidents. This regulation is critical for maintaining the security and integrity of defense information, particularly when it comes to the handling of Controlled Unclassified Information (CUI).
Please clarify the NIST requirement regarding Commercial OFF The Shelf items.
ANSWER: This requirement is NOT a Commercial OFF the Shelf Item. Our office has confirmed through our Headquarters National Guard Bureau (NGB) senior leaders that this Commercial, DFAC Services requirement is NOT considered COTS, since this is a Services requirements. The term COTS refers to Commercial Off-the-Shelf supply requirements. All commercial services do apply against these NIST and SPRS requirements, at the Level 1, Self Assessment process conducted by the Contractor.
It is recommended that all Contractors contact their State, APEX office for immediate assistance or their nearest Federal, Small Business Association (SBA), Procurement Center Representative (PCR). This is a mandatory Department of Defense (DoD) requirement that applies to all Commercial Services contractors, with possibly only a few exemptions as noted within the NIST documentation.

AMENDMENT No. 2 Questions and Answers
1. Will you be updating the solicitation with a clean SF1449? The current SF1449 is a draft.
ANSWER: When the new IDIQ is awarded, that is when the "DRAFT" legend disappears, and not during this phase of the acquisition process.
2. Can you provide pictures of the facility?
ANSWER: Digital Photos shall be posted later this week.
3. Is this a new requirement?
ANSWER: This is not a new requirement.
4. If this is not a new requirement, can you send the current contract #?
ANSWER: W901UZ-19-D-0001
5. Regarding the format of the quote on pg 25 of the solicitation. Factor 1, Experience does not indicate a page limit for this factor. Can you please advise if you would like a limited amount of pages, please.
ANSWER: There is no page limit related to this factor.
6. Does the quote format need to be in a "chart," type format? Can you please describe what best suits the government.
ANSWER: Clear and concise layout of information is what our office is seeking from all interested vendors.
7. Regarding the amendment... Can you specify and provide me with the assessment tool or where I can access the assessment? I am a client of PTAC here in Colorado and they do not have another class offered before the deadline. Please advise. If we are required to have the training prior to the solicitation due date, how would our firm obtain the requirement?
ANSWER: Please contact your Small Business Administrator (SBA), Procurement Center Representative for assistance. I do know what within our region encompassing a number of states, that individual is Mr. James Swartz located in Denver, Colorado.

AMENDMENT No. 1
In accordance with Defense Federal Acquisition Regulations (DFARS) Provision 252.204-2019 and Clause 252.204-2020, which is incorporated within the posted Solicitation document, all interested Contractors desirous of award of this new 5-year ordering period IDIQ contract shall conduct NIST 800-171 Self Assessment resulting in attaining registration and a score within the Supplier Performance Risk System (SPRS).

In summary, the government is only authorized to award a new IDIQ contract to a Contractor that has completed this required NIST Self-Assessment process and does have a Score registered within SPRS. Accordingly, if your 8(a) company is not registered as active, within the last three years, within SPRS, please take immediate steps to do so now, if you are interested in competing for this new 5-year ordering period IDIQ contract award.

Provide Full Food Services in support of the North Dakota Army National Guard's 164TH Regional Training Institute trainees and for all other personnel at Camp Grafton Training Center. Services are being procured through establishment of a Single-Award, Indefinite Delivery Indefinite Quantity (IDIQ) contract with task orders issued by requesting a specific number of meals. This is a five-year ordering period contract, with set timetables once a year for the adjustment of meal pricing based upon Service Contract Act (SCA) Wage Determination increases or other related factors. The required services are fully set forth within the attached solicitation document. All pricing shall be placed on the attached EXCEL spreadsheet and submitted with your quote.
NOTE: All questions against this requirement shall be forwarded to this office by NLT Thursday, April 11, 2024 in order to allow for review and posting on SAM.Gov of the governments answers. Questions are encouraged from posting of this requirement through April 11, to ensure full compliance with all government requirements with the submittal of your company's quote.
