SOURCES SOUGHT ANNOUNCEMENT NO. W9128F24SS002 INDEFINITE DELIVERY/INDEFINITE QUANTITY (IDIQ) SINGLE AWARD TASK ORDER CONTRACTS (SATOCs) FOR RAPID RESPONSE ENVIRONMENTAL SERVICES
This is a SOURCES SOUGHT ANNOUNCEMENT FOR ACQUISITION PLANNING PURPOSES ONLY AND IS NOT A PRE-SOLICITATION NOTICE OR SOLICITATION ISSUANCE. Response to this request for information (RFI) is strictly voluntary and will not affect any business's ability to submit an offer, should a solicitation be released. There is no solicitation document associated with this announcement; this is not a request for proposal (RFP). The requested information is for acquisition planning purposes and does not constitute a commitment, implied or otherwise, that a procurement action will be issued. No entitlement to payment by the Government of direct or indirect costs or charges will arise as a result of the submission of contractors' information. The Government shall not be liable for or suffer any consequential damages for any improperly identified proprietary information. Proprietary information will be safeguarded in accordance with the applicable Government regulations. This RFI constitutes a market research tool for the collection and analysis of information to determine capabilities and capacity of interested contractors.
The Omaha District, U. S. Army Corps of Engineers is seeking information from interested, qualified Small Business Community (SBC) members (for example, Small Businesses (SB), 8(a), HUBZone, Small Disadvantaged Businesses (SDB), Service Disable Veteran Owned Small Businesses (SDVOSB), Women Owned Small Businesses (WOSB), as well as other-than-Small Business firms (“Large” businesses) that are capable of providing services under North American Industrial Classification System (NAICS) code 562910 – Environmental Remediation Services (ERS), which has a small business size standard of 1000 employees or 562119 – Other Waste Collection, which has a small business size standard of $47M. All qualified, interested, capable firms are highly encouraged to respond to this sources sought announcement.
The NAICS 562910 Environmental Remediation industry comprises establishments primarily engaged in one or more of the following:
(1) Remediation and cleanup of contaminated buildings, mine sites, soils, or ground water;
(2) Integrated mine reclamation activities, including demolition, soil remediation, waste water treatment, hazardous material removal, contouring land, and re-vegetation; and
(3) Asbestos, lead paint, and other toxic material abatements.
The NAICS 562119 Other Waste Collection industry comprises establishments primarily engaged in
collecting and/or hauling waste (except nonhazardous solid waste and hazardous waste) within a local area. Establishments engaged in brush or rubble removal services are included in this industry.
Prior Government contract work is not required for submitting a response to this sources sought.
SCOPE OF SERVICES
It is anticipated that the contracts will be required to provide full environmental remediation/ restoration services, including incidental construction and other incidental professional type services, to include site characterization and assessment, to federal or federally funded sites, as defined by NAICS Code 562910. These sites may involve the potential release, or presence of hazardous toxic or radioactive waste, or hazardous or toxic substances. Sites may involve a potential for physical or hazardous risk to protected ecosystems or the environment, or the restoration of such ecosystems.
Project sites may involve the presence of infectious, biological or chemical wastes or contamination, or the presence, release or potential release of all controlled substances, including petroleum and petroleum -based products. Select sites may involve the presence of Ordnance and Explosives (OE), Unexploded Ordnance (UXO) or chemical warfare agent(s). Requirements may require compliance with Resource Conservation and Recovery Act (RCRA), the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and other federal or state regulations.
Sites may involve the incidental design, assembly and installation of preventive or protective systems required to protect human populations, facilities, and ecosystems from the threat of natural disasters, acts of terrorism or acts of war. Sites may involve the management, demolition and debris disposal services, hazardous or non-hazardous, resulting from a natural disaster or act of aggression against the United States. Project(s) may involve a variety of services determined necessary to meet the response demands of the federal government in support of Homeland Defense. To meet such demands, some of the contractors will be required to provide these services on a relatively short notice.
Requirements are for TIME SENSITIVE response actions in support of all Federal Agencies. “Time-sensitive responses” are those that required mobilization within 72 hours (Immediate Response) or 30 days (Rapid Response). This includes, but not limited to environmental actions for Department of Defense (DoD), Department of Energy (DOE), Environmental Protection Agency (EPA), Department of the Interior (DOI), Federal Emergency Management Agency (FEMA) and others. Work may also include response to support Homeland Security and any other time sensitive response deemed necessary and appropriate for usage under this contract.
Small Businesses are reminded under FAR 52.219-14, Limitations on Subcontracting that they must perform at least 50% of the cost of the contract for services and 15%, not including the cost of materials, with their own employees for general construction-type procurement.
As part of any site remediation activities, construction (for example, hydraulic containment systems, treatment plant construction, potable water hook-ups, temporary site stabilization, drainage modifications, removal and disposition of regulated waste, etc.) may also be included in these contracts. See also footnote on the SBA Table of Size Standards related to NAICS 562910.
NAICS 562119 responders: In addition, it is anticipated that the contracts will also be required to provide full debris and waste disposal services, as defined by NAICS Code 562119. These sites may involve organic or nonorganic waste, vegetation disposal and general debris.
Specific Requirements include:
Projects will vary in size, complexity, and location, and will require a high degree of flexibility and adaptability. Contractors must respond quickly and effectively. The diverse scopes of work are time-sensitive, which necessitates a timely response in order to mitigate threat to life and property and/or operational impacts to the government. The level of time sensitivity, and corresponding response requirements, will be determined at the task order level.
TYPES OF CONTRACTS
Best practices and lessons learned from past operations success indicates that it is most efficient to award Single Award Task Order Contracts (SATOC) under different set-asides. In addition, cost reimbursement task orders are necessary for some projects since circumstances do not allow the Corps of Engineers to define its requirements sufficiently to allow for submission of a firm fixed price. The Government currently anticipates awarding up to three contracts to large and small businesses. All sub-categories of small businesses are being considered. It is projected that each contract will have a basic ordering period of four (4) years with a single additional three (3) year option period, for a total of seven (7) years for performance. System Award Management (SAM) will be mandatory for these contracts (see SAM website at https://www.sam.gov).
It is anticipated that a majority of the work will be cost reimbursement type contracts, thus requiring a sufficient cost accounting system. Task orders for firm-fixed price may also be utilized dependent on the nature of the requirement. All task orders will be conducted in coordination with the geographic Major Subordinate Command (MSC) and District Offices.
It is estimated that individual task orders will range from $50,000 up to approximately $10 million and include multiple time sensitive response actions, as well as the potential for multiple, large site investigations/remediation with concurrent performance schedules. Geographic scope for the Unrestricted solicitations may include OCONUS locations.
SUBMISSIONS/RESPONSES
Responses to this Sources Sought Announcement/RFI shall be limited to five (5) pages in a single PDF document and should include the following information (item numbers (1) through (16) below). Additional pages, cover letters, and extraneous materials are NOT desired. Materials, documents, web links, etc. incorporated by reference in responses will not be accessed by the Government for inclusion; all responses must be self-contained, to address the following items.
(1) Firm name, address, point of contact, phone number, and e-mail address.
(2) Firm Unique Entity Identifier (UEI) and CAGE Code.
(3) Firm business size in relation to NAICS code 562910 – ERS, which has a small business size standard of 1000 employees or NAICS code 562119, which has a small business size standard of $47M AS WELL AS TYPE(S) OF SMALL BUSINESS (SB, SDV, SDVOSB, 8(a), etc.).
(4) Has your company previously been awarded a Cost Reimbursable (as defined by FAR Part 16, Subpart 16.3) contract by the Department of Defense?
(5) Does your company have DCAA approved forward pricing rates?
(6) Has your company’s accounting system been audited by DCAA and/or has your company’s accounting system been determined to be acceptable by DCAA/DCMA as part of a pre-award survey or other method within the last three years from the date of your response to this submission?
(7) Over the past five years, approximately what percentage (1-20%, 21-40%, 41-60%, 61-80%, 81-100%, None) of your company’s contracts have been Cost Reimbursable (as defined in FAR Part 16, Subpart 16.3)?
(8) Upon being issued a Notice to Proceed (NTP), identify how long it would take your firm to mobilize to a project location within the geographies listed iin the table (Attachment 1) if issued a task order under one of the proposed SATOCs.
(9) Approximately how many employees does your company have?
(10) How many projects could your company execute simultaneously if the projects were not co-located?
(11) What is the approximate dollar value range of individual contracts typically awarded to your company?
(12) What is the average duration (award to completion) of projects awarded to your company?
(13) On average, how many projects does your company work on simultaneously?
(14) Is your company currently performing work for USACE, or has it in the past? If yes, provide contract numbers or other identifiers and a description of the work performed. Please identify if the work was Cost Reimbursable and/or of a similar nature to that described in the Scope of Services above.
(15) Describe any work your firm has performed for any Federal or DoD Agency which required mobilization within 72 hours (Immediate Response) or 30 days (Rapid Response).
(16) Provide comments, or identify any concerns, your company has regarding the planned solicitation. Note that the Government will not be responding to queries about the proposed solicitation at this time.
