This Sources Sought Notice is issued for information and planning purposes only. The Government will in no way be bound to this information if any solicitation is issued. STATEMENT OF WORK (SOW) 1. Contracting Officer s Point of Contact (POC). 2. Contract Title. TIMS 2000 SP System Upgrade 3. Background. The TIMS video recording and archiving system for Radiology is on hardware and software that TIMS no longer offers support agreements for. The computer operating system is EOL, creating cybersecurity vulnerabilities. The equipment is in the BVAMC s Radiology Service. Access to the controlled area will be provided by POC, Radiology Staff, Police Service, or another designated and authorized BVAMC employee. 4. Scope. Contractor shall furnish the below items and labor: 5. Specific Tasks. The service covered under the contract includes the following: Upgrade Radiology TIMS system, including replacing computer. 6. Performance Monitoring Performance will be monitored by periodic inspections and observation of work. Work will be observed by the CO s POC, or designee, during performance of scheduled maintenance service and inspections and/or during repair service. Equipment operators will be contacted to report on contractor performance when CO s POC, or designee, is not available. 7. Security Requirements. VA ACQUISITION REGULATION SOLICITATION PROVISION AND CONTRACT CLAUSE NOTE: This clause will undergo official rule making by the Office of Acquisitions and Logistics. The below language will be submitted for public review through the Federal Register. The final wording of the clause may be changed from what is outlined below based on public review and comment. Once approved, the final language in the clause can be obtained from the Office of Acquisitions and Logistics Programs and Policy. 1. SUBPART 839.2 INFORMATION AND INFORMATION TECHNOLOGY SECURITY REQUIREMENTS 839.201 Contract clause for Information and Information Technology Security: a. Due to the threat of data breach, compromise or loss of information that resides on either VA-owned or contractor-owned systems, and to comply with Federal laws and regulations, VA has developed an Information and Information Technology Security clause to be used when VA sensitive information is accessed, used, stored, generated, transmitted, or exchanged by and between VA and a contractor, subcontractor or a third party in any format (e.g., paper, microfiche, electronic or magnetic portable media). b. In solicitations and contracts where VA Sensitive Information or Information Technology will be accessed or utilized, the CO shall insert the clause found at 852.273-75, Security Requirements for Unclassified Information Technology Resources. 2. 852.273-75 - SECURITY REQUIREMENTS FOR UNCLASSIFIED INFORMATION TECHNOLOGY RESOURCES (INTERIM- OCTOBER 2008) Government-Furnished Equipment (GFE)/Government-Furnished Information (GFI). No Government supplied Equipment or Information is required or anticipated. 9. Other Pertinent Information or Special Considerations. Only Manufacturer Trained Service Engineers/Technicians or Manufacturer Authorized Service Engineers/Technicians will perform services and repairs. a. Identification of Possible Follow-on Work. No Follow-on work is anticipated. b. Identification of Potential Conflicts of Interest (COI). No Known COI c. Identification of Non-Disclosure Requirements. Contractor will have only incidental access to Sensitive or Proprietary Information. Any Patient Information that may have been observed during the work must not be discussed, or shared, with anyone beyond the Hepatology Service Staff or any person who does not have the need to know such information. d. Packaging, Packing and Shipping Instructions. N/A e. Inspection and Acceptance Criteria. POC, or designee, will verify that the unit is working within Manufacture s specifications after completion of service or repair. 10. Risk Control. The Contractor shall obtain all necessary licenses and/or permits required to perform this work. Contractor shall take all precautions necessary to protect persons and property from injury or damage during the performance of this contract. Contractor shall be responsible for any injury to any contractor representative, or others, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by the contractor s fault or negligence. If Patient Information may have been observed during the performance of work, the Contractor will not discuss any patient issues that may have been observed during the work. 11. Place of Performance. All service will be performed at the BVAMC Radiology Service. 12. Period of Performance. Period of service is TBD. 13. Delivery Schedule. Service Reports will be emailed or faxed to POC by the 5th workday after completion of the work.
