Specifications include, but are not limited to: The City’s high-level objectives for this project are to enter into a lease agreement that maximizes the City’s rental income and maintains or establishes a long-term reliable lease agreement between the City and the lessee. The City would expect that the selected consultant would, at a minimum: • Review the current (expired) lease agreement, the current site, and site conditions. • Review the proposed terms of the current lessee to determine if fair market values are being proposed. • Provide analysis of similar local lease agreements. • Determine and provide a written recommendation of the procurement method that would be most advantageous to the City, whether that be renegotiation with the current occupant of the site or a competitive bidding process. A recommendation must provide a full analysis of potential benefits and disadvantages of both renegotiation and competitive bidding in such detail that the City can make a final determination of procurement method. In other words, cost is not the only consideration as there may be various factors or risks to be considered individually, including disruption to the property, stakeholder objections, loss of connectivity, potential negotiation risks, etc., that may supersede marginal financial benefits. • If site conditions, regulations, or other market conditions favor a renegotiation of a lease with the current lessee, the consultant, with the advice of the City Attorney, will assist the City in the negotiation of the renewed lease terms including recommended market rates and required lease language.
