Specifications include, but are not limited to: 1. The Contractor shall be licensed with the Oregon Department of Agriculture prior to contract signing. The Contractor shall have a minimum level of pesticide application experience as outlined in Section 1.3.01.1. 2. The Contractor shall provide Pollution Liability Insurance in addition to all other insurance specified herein. See Section 1.3.03. 3. The Contractor shall provide a money-back guarantee on all work specified herein as set for below. See Section 3.1.01. 4. The Contractor is responsible for all property damage and for all clean up and restoration costs associated with any chemical spill. See Section 1.5.03. The Contractor is not responsible for any damages caused by sewer stoppages. 5. The Contractor shall use a reduced-pressure-zone backflow prevention device whenever accessing fresh water for mixing chemical. 6. The Contractor shall return every 4 to 8 months throughout the life of the guarantee, in order to evaluate the success of the project, and to arrange for any free guarantee work that may arise. 7. Many of the sewers to be treated are located in hard to access easement areas, i.e. behind houses and/or in rough terrain. The Contractor should examine the work site and familiarize themselves with the actual conditions and requirements of the job. See Section 2.3.03. 8. Some sewers are located in heavy traffic areas. The Contractor shall be responsible for providing traffic control in conformance with the current edition of the Manual on Uniform Traffic Control Devices (MUTCD), as published by the US Department of Transportation - Federal Highway Administration; the Oregon Supplements to the MUTCD as published by the State of Oregon Department of Transportation. See Section 1.5.04. 9. The Contractor may use subcontractors to provide traffic control. All other use of subcontractors shall not be permitted. 10. The Contractor shall comply with all Federal, State and Local laws, with special attention to those laws that pertain to the handling, transportation and use of any hazardous materials and disposal of all pesticide containers. a. All pesticide products must be registered with the USEPA and with the Oregon Department of Agriculture. b. The Contractor’s on-site supervisor must supervise all work. The Contractor’s supervisor must be an applicator certified by the Oregon Department of Agriculture. Proof of Certification must be submitted to the Owner prior to work commencing. 11. The Contractorshall protect the Owner’s wastewater treatment plants. See Section 1.5.02.
