Specifications include, but are not limited to: Examples of work that the firm will be expected to perform might include the following tasks: 1. Review the claim, and the project documentation to assist VTrans in determining the legal basis and probable outcomes of specific claims. 2. Help develop a defense strategy based on the legal basis and underlying facts associated with Construction Claims 3. Assist the Construction Engineer and the Chief Engineer in drafting decisions in response to Construction Claims. 4. Assist VTrans in responding to Freedom of Information Act (FOIA) or discovery requests associated with Construction Claims 5. Represent VTrans in mediation if VTrans and the Contractor chose that resolution tool. 6. Participate in the depositions of individuals with knowledge of the claim or the project. 7. Represent or aid in the representation of VTrans before the Transportation Board. 8. Represent or aid in the representation of VTrans before an appropriate Court.
