Specifications include, but are not limited to: The District needs to begin acquiring property for the following projects: A. General Scope As necessary, Consultant will coordinate efforts for the purchase of fee simple ownership of property and, incidental easements if necessary. Applicants must follow requirements imposed District resolutions and State law associated with the acquisition of property. The District is only interested in a “willing seller/willing buyer” approach to any potential acquisition. The District does not intend to use eminent domain powers at this time. Consultant will be required to provide a single point of contact who will coordinate with the designated District representative. District will provide the consultant with the general character, general geographical areas, minimum size/area requirements based on District needs. Consultant shall identify parcels meeting the District’s criteria. The District will provide direction as to which properties Consultant should begin negotiations. The Consultant will also provide the District with an opinion of fair market value that may require outside appraisals and title searches. The Consultant may be the District’s representative during negotiations with potential sellers. If the District authorizes the Consultant to accept an offer, Consultant will perform all activities to bring the sale to closing. B. Minimum Requirements Consultant shall: 1. Be able to document at least five (5) years of experience in residential, commercial, land and industrial real estate. 2. Be familiar with all aspects of real estate transactions, including negotiation, purchase contracts, appraisals, and title insurance. 3. Hold a current Utah Real Estate license as an Agent or Broker. 4. Be familiar with reading and interpreting right‐of‐way maps, deeds, and engineering drawings. 5. Have at least three (3) years’ experience working with public entities in Utah. C. Deliverables 1. Consultant will make initial contact with property owners to coordinate appraisals, feedback, and help circulate relevant project information. 2. Consultant will work with the District’s Consultant Surveyor to provide accurate legal information to property owners and other professionals involved in the process. 3. Consultant will provide/coordinate appraisal services which are sufficient to establish the appropriate compensation to be paid to property owners for each easement, parcel or portion thereof which is acquired for the Project. Consultant shall prepare and review all appraisal reports submitted for the acquisition. All appraisals must be completed under the Uniform Standards of Professional Appraisal Practice by a Certified General Appraiser. Consultant will provide District a Just Compensation document to sign before presenting offer to property owner. Consultant will not make an offer to property owner without District's consent and agreement to offer. 4. Consultant will be primary direct contact for property owners; present offers; negotiate on behalf of the District; and provide the District with all necessary real estate documents associated with the sale of property or purchase of easement.
