a. Maintain the confidentiality of student information in accordance with the Family Educational Rights and Policy Act (FERPA), state privacy laws, and OSPI policy. b. Refrain from providing legal advice to either party regarding state or federal nondiscrimination laws, OSPI WAC 390-190, or any other applicable law. c. Maintain a neutral relationship with the parties. d. Assist with complaint intake by reviewing and summarizing all provided documentation and evaluating the complaint for investigation or dismissal, in accordance with OSPI’s internal complaint evaluation procedures. e. Review the allegations contained in the complaint and the issues identified by OSPI. f. Review documentation provided by the LEA in response to the complaint and determine if additional information may be needed from complainant, LEA, or other third parties. g. Prepare a draft memo outlining the investigation findings, legal analysis, and recommendations for resolution or corrective actions for review by OSPI within sixty (60) calendar days of assignment by the OSPI unless a time extension is granted because of the scope of the investigation, including number of issues or systemic issues, or exceptional circumstances. The memo shall contain procedural history, legal standards, findings of fact, legal analysis, proposed conclusions, and if necessary, proposed corrective actions. h. Prepare draft correspondence, including decision letters and voluntary resolution agreements for review by OSPI. i. Participate in investigation status meetings with the Equity and Civil Rights Program Attorney and Managing Attorney at least once a week or once every two weeks, depending on need. j. Return all documents to the OSPI upon completion of the investigations.
