A.3.8 Use of Buses, Equipment, and Facilities Contractor understands that all vehicles, facilities, office equipment, office furniture, and shop equipment provided by RABA under this Contract are the property of RABA and shall be used only to provide services included under this Contract. No vehicle, facility, equipment, or furniture provided by RABA is to be used for any other purpose without prior approval by RABA’s Transit Manager or their designee. The Contractor’s right to use RABA buses and all provided equipment is merely a license that is terminable at will by RABA with reasonable notice, and such vehicles may not be transferred or assigned by the Contractor. Contractor’s use of the RABA O&M Facility shall be subject to the terms and conditions of the APPENDIX E. FACILITY OCCUPANCY AGREEMENT. A.3.9 Bus Operator & Other Staffing Requirements Contractor shall be entirely responsible for the employment and supervision of bus Operators and other employees necessary, and in sufficient numbers, to perform all system operations functions during all hours of operation. At a minimum, the Contractor shall provide the level of staffing required for meeting the requirements for ongoing operations and maintenance as described in the Management and Operations Plan included with Contractor’s Proposal. The Contractor shall always be responsible for providing qualified individuals for all enumerated personnel positions during the Contract period. Such responsibilities shall include, though not necessarily limited to: Recruitment Screening Selection Training Supervision Proper licensing Employee relations Evaluation Discipline Retraining Termination Scheduling/Rostering
