1. Contractor must be able to provide Bituminous Materials to the requesting departments, which meet or exceed the specifications contained in this document. 2. Delivery charge shall include material cost and all costs associated with loading, hauling and unloading. Delivery charge will start at the plant address and end at the closest point to the worksite. 3. Materials shall meet the requirements of Section 1015 of the most recent version of the Missouri Standard Specifications for Highway Construction. 4. Franklin County, at its own expense, reserves the right to sample any material, for the purpose of having an independent laboratory test of the material for conformance to specifications. Product that does not meet the specifications listed will cause all of the shipments to be returned at the bidder’s expense. 5. For the purchase of CRS-2P and CSS-1H : The contractor is responsible for adjusting oil prices according to Section 109.15 of the 2018 Missouri Standard Specification for Highway Construction, MoDOT’s Asphalt Cement Price Index prior to submitting invoice. The Contractor may request to not use MoDOT’s Asphalt Cement Price Index using a letter with the bid documents. MoDOT’s Asphalt Cement Price Index can be found posted on the MoDOT website under Business, then Contractor Resources, then Bid Opening Info, then General Information and then Asphalt Price Index. Viewing the month of the letting will show the Asphalt Price Index established that month. The Asphalt Cement Price Index is posted the Monday prior to the third Friday of each month. Please use the most current Asphalt Cement Price Index. 6. The adjusted contract unit price will be applied to the actual amount of asphalt binder used by the Contractor for all asphalt items. The percentage of virgin asphalt shall be supplied by the Contractor at the time of bidding and will be the basis for adjustments. The effective asphalt obtained from the use of Recycled Asphalt Pavement (RAP) and/or Recycled Asphalt Shingles (RAS) will not be eligible for adjustment. 7. To determine the adjustment for any material specified in this provision the following formula will be used. A = (B x C) x (D-E) Where: A = Adjustment for oil placed during monthly average index period B = Tons of oil Placed during the monthly average index period C = % of virgin asphalt binder as listed in the job mix formula in use D = monthly average price at time mix placement E = monthly average price at time of bid 8. Invoices shall show the percent of asphalt. Submitted invoices that do not show the percentage asphalt will be returned unpaid and may be re-submitted with the requested information. 9. Price changes are to be submitted in writing.
