Transportation services will be provided to children (and in some cases their family or guardian) who need transportation to participate in needed programs, activities or appointments. Travel will take place in a vehicle meeting all vehicle requirements outlined in this solicitation from the pickup location (“Point A”) to the destination location (“Point B”) or from the pickup location (“Point B”) to the destination location (“Point C”) and a return trip to Point A. In some instances, the driver must remain at Point B until such time as the child is ready to return to Point A. Any employee/driver assigned to this Contract will be an employee of the awarded Contractor (herein referred to as Provider in Section III) or its subcontractor. All wages, insurance and tax liabilities related to their employment are the responsibility of the Provider. The State will have the right, in its sole discretion, to reject the services of any employee/driver supplied by the Provider if said person is not fit for duty (for example, evidence of drinking, unprofessional appearance of person or vehicle, unprofessional attitude, etc.). In such instances, Provider will not be allowed to bill the using agency for the rejected employee. Contractor shall abide by the respective agency(ies) BAA. Note: If you are a provider of Group care residential services or any other service which is provided in a "group home" format or provides services for children with emotional challenges in a “treatment home” format, those contract requirements for transportation supersede this contract. This transportation contract is to be used for services outside of those contract requirements. For example, transportation needed outside of the distance stipulated per round trip in their scope of services. The using agencies will be solely responsible for authorizing service for their client. Changes in the frequency or duration of services may be made at any time by these agencies. The State nor the using agencies are responsible for payment of any unauthorized services. At times (for example, in an emergency situation), using agencies may need to contact several Providers on Contract and use the Provider who can fill their request first. Other contacted Providers will then be notified to cancel the request. An example of such scenario is a using agency who contacts a Provider and must leave a message. Depending on the urgency of the request, they may need to call a different Provider. Any staff assigned to this Contract must have provided service to emotionally challenged children for at least 6 months, must have a valid driver’s license and have a clean driving record.
