2.1.1 The purpose of the contract is to establish a Qualified Vendor’s List (QVL) for Multiprotocol Label Switching (MPLS) Services for the Office of Administration, Information Technology Services Division (OA-ITSD) (hereinafter referred to as state agency) for various locations across the State of Missouri, on an as needed, when needed basis, in accordance with the provisions and requirements stated herein and to the sole satisfaction of the state agency. 2.1.2 The contractor shall either provide the services directly or shall provide staff who must comply with the requirements stated herein. Therefore, references to “the contractor” or “qualified vendor” throughout this document shall also be deemed to include the staff provided by the contractor. 2.1.3 Because the State of Missouri needs multiple contractors throughout the state to effectively meet the state agencies’ demand for MPLS services, the Division of Purchasing reserves the right to add more contractors subsequent to the initial award of contract(s) by conducting a separate procurement process(es) to supplement the list of qualified vendors. Qualifying vendors may be added as additional contractors subject to the same considerations identified herein regarding award of a contract 2.1.4 Mandatory Use of Contract – The contractor shall provide services on an as needed, if needed basis. The State of Missouri does not guarantee any usage of the contract whatsoever. However, any state agency needing the services shall be required to use the contract, by requesting ITSD issue an MPLSQ, unless an exemption is granted by the Division of Purchasing. The contract shall not be construed as an exclusive arrangement and if it is in the best interest of the State of Missouri and approved by the Division of Purchasing, a state agency may obtain alternate services elsewhere. a. In consideration of the original cost of implementation of MPLS connectivity, subject to the non-appropriation of funds provision of the RFP and subsequent contract. b. The state agency may utilize this contract to establish new MPLS Service Quotations with qualified providers during the original contract period only. 2.1.5 The contractor shall understand and agree that this contract shall serve as the contract document containing requirements, terms and conditions which shall govern all MPLS Service Quotations established under the authority of this contract.
