General Requirements: The contractor shall provide new plastic trash bag production equipment for the state agency in accordance with the provisions and requirements stated herein and to the sole satisfaction of the state agency. Contractor’s Obligation: Unless otherwise specified herein, the contractor shall furnish all material, labor, facilities, equipment, and supplies necessary to provide the products required herein. Contact Person: The contractor shall designate a contact person who shall serve as the contractor’s contact and shall be the liaison between the contractor and the state agency by no later than five (5) business days after authorization to proceed. The contractor shall understand and agree that the state agency reserves the right to request any of the contractor’s personnel assigned to provide the deinstallation or installation be removed without just cause. The contractor shall understand and agree that the state agency will allow the contractor a reasonable time to find a replacement. The state agency shall approve all replacement personnel. The state agency reserves the right to require background checks and non-disclosure agreements (NDA) of selected contractor personnel, at the contractor’s expense. Optional Core Equipment Trade-In: The state agency has the following core equipment to offer as an optional trade-in for a price adjustment (trade-in allowance) as indicated on Exhibit C, Pricing Pages. While the trade-in of existing equipment is optional to the contractor, it will be considered as part of the cost evaluation. The trade-in allowance for the equipment specified below, will be based on the contractor’s awarded response to Exhibit C, Pricing Pages. Upon acceptance of the trade-in allowance (Line Item 6) by the state agency, the trade-in allowance awarded (Line Item 6) will be applied as a credit to the purchase price awarded (Line Item 2). Make/Model: Plascon BSM 1300 Age: Purchased 2001 Usage: Hour unknown Working Condition: Not working, some parts used to repair working machine Make/Model: Plascon BSM 1300 Age: Purchased 2003 Usage: Hour unknown Working Condition: Currently in use to produce plastic bags The contractor shall be responsible for all costs associated with uninstalling, packaging, delivery, shipping or any other fees associated with removing and transporting the trade-in equipment to the contractor’s destination. In the event the trade-in value on the equipment is awarded, the contractor shall understand and agree that the trade-in identified herein will be released “as-is.” Neither the State of Missouri or the state agency has agreed to or promised any type of guarantee or warranty, whether expressly written or implied. The state agency’s trade-in equipment shall be picked up by the contractor at Missouri Vocational Enterprises, Chillicothe Correctional Center, Clothing Factory, located at 3151 Litton Road Chillicothe, MO 64601, no later than the date specified by the state agency, unless otherwise mutually agreed upon between the contractor and the state agency. Deinstallation Requirements: The contractor shall unistall all existing plastic trash bag production equipment prior to installation of the new plastic trash bag equipment purchased, at no additional cost to the state agency. Uninstalling should consist of disconnecting airlines and unplugging the equipment.
