Please note: This is a Sole Source Notification. Specifications include, but are not limited to: 1. Must assign one or more qualified attorneys who has experience and training to each assigned case to represent individuals charged with capital aggravated murder under Rule 8 of the Utah Rules of Criminal Procedure. 2. Upon notice of assignment to a case, review current workloads to determine if effective Services can be provided on the assigned case. The contract must consider any material conflict of interest. 3. As soon as practicable, enter an appearance by all Attorneys assigned to the case on behalf of the Indigent Inmate charged with Aggravated Murder. 4. Provide effective, timely, and continuing Services for indigent inmates, pursuant to the obligations set forth in Utah and Federal law, and this agreement. 5. Designate responsibility for sharing work on a case equitably, with the Rule 8-qualified attorney to be chair. 6. Provide services including but not limited to, consultation with clients, pursuing available evidence through discovery, investigating facts and circumstances, using other defense resources as appropriate, researching the law specific to inmate issues, filing pertinent motions, subpoena relevant documents, and appearing at court. 7. Make reasonable efforts to visit and communicate with indigent inmates, return telephone calls, and otherwise be accessible. 8. Travel to the Court for hearings after appointment, including preliminary hearings, status hearings, motion hearings, trials, review hearings, and all other related hearings. 9. Provide the full scope of Services continuing up to and including the filing of any notice of appeal and docketing statement, but not any briefs on appeal. 10. Perform all legal services required under this contract in a professional and ethical manner, consistent with the guidelines and standards set forth in the American Bar Association Guidelines for the Appointment and Performance of Counsel in Death Penalty Cases, the Utah Rules of Professional Conduct, and such other applicable law, rule, and case law governing the practice of law in the State of Utah together with such other regulations or statutory provisions to which the Contractor(s) may be subject as a result of federal law.
