Specifications include, but are not limited to: 1. The Contractor shall use necessary practices to maintain the existing general appearance of the park. 2. The Contractor shall maintain and use the land for crop production as specified in each lot and shall do so in existing fields only as per map attachment(s). 3. The Contract period is to begin from January 1, 2025, to December 31, 2029, with 1 optional 5-year renewal. 4. The Contractor will retain all profits from sale of crops yielded as a result of operations under this contract. 5. The Contractor shall remove all equipment from premises within 30 days of the termination of this contract. 6. All fields shall be kept free of litter, including but not limited to inoperable equipment. 7. The Contractor shall coordinate all farm activities with designated park staff, especially the spraying of chemicals, shall be coordinated with the Commonwealth to avoid conflict with routine park operations or special park projects. The Commonwealth will make every attempt to provide reasonable notice to the Contractor of any scheduled special events. 8. The Commonwealth reserves the right to remove any and all acreage, at any time, for resource management, park development or special events or activities. The contractor will be compensated as follows: a) If agricultural crops are destroyed: 1) The new acreage will be determined by the DCR/Parks Natural Resource Section GIS specialist. 2) After harvest, the average yield per acre of the crop planted in the field or similar fields in the area will be supplied to the Commonwealth by the Contractor. 3) The rate paid to the Contractor at market for the crop will be multiplied by the yield destroyed. That amount will be deducted from the normal rent due that year. 4) The contractor shall receive no crop compensation for any acreage removed from the contract, except when crops have been planted and destroyed. The compensation will be for only that year. b) If agricultural crops have not yet been planted: 1) Any acreage removed from the contract prior to crops being planted shall be determined by the local Farm Service Agency using their aerial photography and filed plotting programs. 2) The rent due will be reduced by the bid price per acre multiplied by the number of acres removed from production. 9. The Contractor agrees to meet with the commonwealth to reconfigure fields to provide easier shapes to farm and remove low yield areas within 90 days of the contract award. 10. The Contractor shall agree upon award to provide the Commonwealth of Virginia with a copy of their current certificate of insurance and any required operation licensure.
