REQUEST FOR PROPOSAL FOR MUNICIPAL PROSECUTION
SEPTEMBER 2017

This is a request for Proposal for a Municipal Court Prosecutor to provide legal services for the Municipal Court. This request for proposal is intended to gather pertinent information concerning the ability of an individual attorney to meet the municipal court needs of the Town of Nederland.

The Town of Nederland is interested in establishing an ongoing relationship with an attorney to ensure high quality, necessary, responsive, timely and cost-efficient legal services for the Town of Nederland’s Municipal Court. We expect that the attorney chosen will be experienced in the type of legal services required on an ongoing basis by statutory towns and will be familiar with the legal issues associated with such municipalities.

Scope of Services:

Prosecutes all violations of Town ordinances and all other proceedings brought by the Town in Municipal Court, which includes meeting with defendants and their attorneys; meeting with police officers, code enforcement officials, witnesses and victims; responding to written motions of defendants; processing and preparing cases for trial; presenting cases in jury trials and trials to the court; researching the law; and representing the Town in appeals from Municipal Court.
Performs professional legal work (carrying the highest levels of volume, complexity, consequence, autonomy and responsibility), including regularly drafting subpoenas, motions, notices and proposed orders.
Performs such other duties as are required by the Town Attorney.
Attends Municipal Court (once a month) and performs other services related thereto, as necessary.

Experience Required/Preferred

Must be licensed to actively practice law in the State of Colorado and be in good standing with the Colorado Supreme Court. Experience in other areas of municipal law is desirable, but not required. Must have the ability to communicate effectively and diplomatically with co-workers, the Municipal Judge, Court Clerk, defendants and their attorneys, and the general public. Must possess a good working knowledge of the Nederland Municipal Code, local court rules, Colorado Municipal Court Rules, and Colorado Rules of Evidence. Must have the ability to perform with integrity; demonstrate honesty and sensitivity to ethical issues; and avoid actual or apparent impropriety and/or conflicts of interest. Must exercise appropriate judgment, consistent with the highest levels of volume, complexity, consequence, autonomy and responsibility attending the position.

To be considered, please submit the following: resume and cover letter; fee proposal, and three relevant references, (which the Town will only contact with your permission). Note: The Town prefers and may give priority to fixed fee proposals.

The Town of Nederland Municipal Court is held on the second Friday of each month starting at 10:00 a.m. in the Nederland Community Center (750 North Highway 72). Please specify your availability to attend these specific court sessions as well as general availability for Town projects related to municipal court.

Quality legal services are worth their cost only if the services are focused on the specific needs of the Town. The Town is seeking an attorney who can establish successful communication and coordination on an ongoing basis with the Municipal Court Judge, Municipal Court Clerk, professional staff, and consultants.
