The Charter Township of Clinton (Township) is seeking proposals from experienced and qualified Consultants (and subconsultants) to provide an Environmental Assessment Aggregate and several expected detailed environmental studies for a Clinton River water trail project that is utilizing U.S. Department of Housing and Urban Development (HUD) grant funding. If your consulting team has the required certifications and necessary experience for this type of work, and you are interested in providing these services, please indicate your interest by submitting a written proposal for the work
The project consists of preparing an environmental assessment aggregate and several expected environmental studies under the National Environmental Policy Act. The Public Agency responsible for the funding is HUD in each instance and therefore should be completed to standards dictated by federal regulations found at 24 CFR Part 58. In addition to the aggregate Environmental Assessment being required, the following environmental studies that need to be conducted include:
• Native Mussel Survey (Diver Likely at the Structure Removal due to depth)
• Wetland Delineation
• Wetland Permitting
• Asbestos-Containing Materials Inspection
This project will require consultation with a state certified historical architect and archaeologist for correspondence with and project approval from the State Historical Preservation Office. While each project will require full and comprehensive assessments, the Clinton River Water Trail Improvements will require particular attention to compliance with the Endangered Species Act, Floodplain Management, the Wild and Scenic Rivers Act and other aforementioned studies since it is a water resources project. Project locations and descriptions are available for review and are included in the RFP package.
AWARD OF CONTRACT
The Charter Township of Clinton reserves the right to accept or reject any or all Proposals, to award the agreement to other than the low proposal, to negotiate the terms and conditions of all and any part of the Proposals, to waive irregularities and/or formalities, and in general to make award in the manner as determined to be in the Township’s best interest and its sole discretion.
Each Consultant agrees to waive any claim it has or may have against the owner, engineer, and their respective employees, arising out of or in connection with the administration, evaluation, or recommendation of any Proposal.
STATE AND FEDERAL REQUIREMENTS
Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this project, and that the contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin, in accordance with Executive Order 11246 Equal Employment Opportunity and Notice of Requirement for Affirmative Action to ensure Equal Employment Opportunity, and that the contractor will comply with Section 3 of the Housing and Urban Development Act of 1968, as amended.
The Contractor and sub-contractors must comply with Davis Bacon Act July 2nd, 1964 (Title 40§ 276A). The Equal Employment Opportunity Act September 28, 1965 No. 11246, all United States Department of Labor Regulations and standards Title 29, 1,3 and 5, and Title 18, U.S. C., Section 874 known as “Anti-Kickback Act” and the Federal Occupational Safety and Health Act of 1970.
