This primary work shall be included together with miscellaneous site furnishings and all other incidental work outlined on the Bid Form, which includes site clearing/removals, tree removals and restoration.
PLANS AND SPECIFICATIONS
Plans and specifications must be obtained through BidNet, formerly the Michigan Intergovernmental Trade Network (MITN), at https://www.bidnetdirect.com/mitn, after 8:00 A.M. on Wednesday, January 25, 2023. BID SECURITY
Bids must be submitted on the forms furnished by the Township Clerk or the Township Engineers in a sealed envelope marked:

A certified check, bank draft, or satisfactory bid bond, executed by the bidder and a surety company, payable to Clinton Township, in an amount at least equal to five percent (5%) of the bid amount, shall be submitted with each bid.
BONDS AND INSURANCE
The accepted bidder shall be required to furnish a satisfactory Performance Bond, and Labor and Material Bond in the amount of 100% of the Contract Price, and Maintenance and Guarantee Bond of 100% for two years of the Final Contract Price. The cost of the bonds will be paid by the accepted bidder.
WITHDRAWAL OF BIDS
No Bid may be withdrawn for a period of sixty (60) calendar days after receipt of bids.
AWARD OF CONTRACT
Each bidder agrees to waive any claim it has or may have against the Owner and their respective Employees, arising out of or in connection with the administration, evaluation, or recommendation of any bid. Clinton Township General Funds and Michigan Natural Resources Trust Fund monies are to be utilized for the project construction.
The Charter Township of Clinton reserves the right to accept or reject any or all bids, to award the agreement to other than the low proposal, to negotiate the terms and conditions of all and any part of the bids, to waive irregularities and/or formalities, and in general to make award in the manner as determined to be in the Township’s best interest and its sole discretion. Bids shall remain firm for a period of sixty (60) days.
The contractor and all subcontractors must comply with all requirements of 1976 PA 453 (Elliott-Larsen Civil Rights Act), the 1976 PA 220 (Persons with Disabilities Civil Rights Act), and Executive Directive 2019-09, as amended. In accordance with these laws, all contracts the grantee enters into must contain a covenant by the contractor and any subcontractors not to discriminate against an employee or applicant for employment with respect to hire, tenure, terms, conditions, or privileges of employment, or a matter directly or indirectly related to employment, because of race, color, religion, national origin, age, sex, height, weight, marital status, partisan considerations, or a disability or genetic information that is unrelated to the individual’s ability to perform the duties of a particular job or position.
The project shall commence immediately following a notice to proceed per these contract documents. Due to the unprecedented unknown availability of various materials and equipment for this project, the substantial completion will be determined after the awarded bidder, Engineer and Owner mutually agree upon a substantial completion date and phasing plan for the Work.
