Right of First Refusal
Request for Qualifications
Objective Overview
The City of Garden City will select a developer to collaborate in a new reinvestment program through acquisition/redevelopment/resale of tax-foreclosed, single-family residential structures. These properties are to be acquired from the Wayne County Treasurer’s Office through the City’s Right of First Refusal. Properties are primarily vacant with the potential that some properties may be occupied. This Request for Qualifications (RFQ) will be for the implementation of an acquisition, redevelopment and resale component of the program.
Contractual Agreement: A contract will be executed between the City of Garden City and the successful firm(s) for a three year period. Successful firm(s) will be required to have a minimum $250,000 in the form of a line of credit from an approved financial institution, or cash in escrow held by the City of Garden City, no later than ten (10) days prior to contract execution.
Eligible Projects: The City of Garden City has implemented an acquisition/redevelopment/resale program Tax foreclosed single-family homes must be rehabilitated/redeveloped and sold for owner-occupancy only. Firms are required to coordinate with the Garden City Building Department for all required building permits, inspections, etc. All homes will be rehabilitated/redeveloped to meet, at a minimum, the Garden City Building Code and ordinances. Firms are required to use Energy Star and energy efficient technologies when redeveloping all properties.
Acquisition and Limitation Details: The selected firm(s) will have twelve (12) months to complete the home rehabilitation/redevelopment of each acquired property, and to have homes listed for sale. Firms will have 18 months to complete sales transactions on all properties.
Use of Funds: All properties/homes will be owner-occupied, single-family residential units and sold only to owner-occupied persons. Although not required, selected firm(s) are encouraged to seek out Home Buyer Assistance for potential homebuyers.
Marketing: The firm(s) under contract with City of Garden City must certify that it will affirmatively market the properties through a local realtor, MLS, or reputable internet based real estate marketing webpage. Verification of previous affirmative marketing efforts may be required by the City.
Woman and Minority Business Enterprise (W/MBE) Outreach: The firm(s) under contract with City of Garden City must certify that it will encourage participation of W/MBE subcontractors. Verification of outreach efforts will be required by the City.
Scope of Services
The City of Garden City will select a developer to perform the following services with the intent to meet the objectives of the program
- Garden City reserves the right to have first selection of tax foreclosed properties that are available for purchase from the First Right of Refusal (FROR) Tax Foreclosure Property List. Selected firm(s) will then be able to select from the available pool of tax foreclosed residential properties made available through the Wayne County Treasurer.
- The initial acquisition of homes will be funded by City of Garden City via the Wayne County Treasurer’s Office – First Right of Refusal. The City must be reimbursed within five (5) business days for the acquisition costs (Intent to Purchase)
- The Program will be funded by the selected firm(s). Selected firms will be required to have a minimum $250,000 in the form of a line of credit from an approved financial institution, or cash in escrow held by the City of Garden City, no later than ten (10) days prior to contract execution.
- Once the City receives the initial Quit Claim Deed transferring ownership from the Wayne County Treasurer, a Quit Claim Deed will be prepared by Garden City and delivered to the purchasing firm(s). Purchasing firms shall pay all closing and recording fees. The selected firm will prepare the purchase agreement, property transfer affidavit, homestead exemption and all closing documents.
- Selected Firms will be responsible for up keep of homes before, during and after the redevelopment, up to the final sales date (i.e. grass cutting, snow removal, property maintenance, etc.) Insurances must be maintained from date of acquisition and all property taxes for each acquired home/property are to be paid on time by contracted firm(s) Property taxes for each home are to be paid on time by the selected Firm(s).
- All rehabilitation/redevelopment work must be completed within 12 months of the contract start date. All projects must have completed sales transactions by the contract end date. Firms must submit proposed schedule (with activities broken down) and implementation strategy.
- All sales transactions (closings) are to take place using an approved title company. Firms must provide title policy to each perspective homebuyer.
- The City of Garden City will not be responsible for any leins, assessments or levies owed on the property. The selected developer will be responsible to cover all arrearages.
Deadline for Submittal: Sealed responses to this RFQ must be received no later than
2:00 p.m. on THURSDAY, MAY 9, 2019. Mark outside of envelope “Neighborhood Stabilization – Right of First Refusal RFQ” Applications received after the deadline will not be considered.
Applications may not be submitted via fax or email.
Number of Copies and Mailing Address: Applicants must submit
two (2) hard copies, one of which must be marked as a signed original, to the City of Garden City, Clerk’s Office, 6000 Middlebelt, Garden City, MI 48135. The application should be assembled so that it follows a logical and consistent format. All materials should be 8 ½ x 11”. Fold-outs, brochures, photographs, etc., should all be formatted to these guidelines.
Proposal Costs: All costs of responding to this RFQ are the responsibility of the applicant.
