NOTICE TO BIDDERS MORRIS COUNTY MUNICIPAL UTILITIES AUTHORITY MORRIS COUNTY, NEW JERSEY SEALED BIDS FOR OPERATING THE TWO MORRIS COUNTY SOLID WASTE TRANSFER STATIONS, LOCATED IN PARSIPPANY-TROY HILLS TOWNSHIP AND MOUNT OLIVE TOWNSHIP, INCLUDING PROVIDING TRANSPORTATION AND DISPOSAL OF ALL SOLID WASTE RECEIVED AT THE TRANSFER STATION FACILITIES The Work under this Bid shall include furnishing all labor, equipment and materials necessary to provide services as more particularly described in the Bid Documents. Sealed Bids will be received by the Morris County Municipal Utilities Authority (“MCMUA”) on Tuesday the 6th, of January 2014 at 2:00 p.m. prevailing time at the Morris County Municipal Utilities Authority office located at 214A Center Grove Road, Randolph, NJ 07869 and at that time and place will be publicly opened and read aloud for the “Operation of the Two Morris County Solid Waste Transfer Stations Including Transportation and Disposal of All Solid Waste Received at the Transfer Stations.” The Bids shall be in accordance with the Bid Documents on file with the Morris County Municipal Utilities Authority. No Bids shall be received after the time and date specified, and no Bids shall be received by mail. Bids shall be hand delivered or received by courier service (including but not limited to Fed Ex, UPS, DHL, etc.) (date and time recorded). The MCMUA is soliciting Bids for combined operation, transportation and disposal services for a period of five (5) years. The MCMUA owns two (2) transfer stations, one located in Mt. Olive Township, New Jersey and one located in Parsippany-Troy Hills, New Jersey (collectively, the “MCMUA Transfer Station Facilities”). The transfer station located in Parsippany-Troy Hills has a not-to-exceed permitted daily capacity of 1,380 tons-per-day with a not-to-exceed weekly permitted capacity of 6,900 tons-per-week. The transfer station located in Mt. Olive Township has a not-to-exceed permitted capacity of 975 tons-per-day. The combined operation, transportation and disposal services involves providing all labor and equipment and materials to operate the MCMUA Transfer Station Facilities, including providing all labor, equipment and materials to Transport and Dispose of all County Solid Waste, as that term is defined in the Bid Documents, from the MCMUA Transfer Station Facilities. The operation of the MCMUA Transfer Station Facilities and Transportation and Disposal of County Solid Waste from the MCMUA Transfer Station Facilities shall be performed in accordance with all Permits, including the Solid Waste Facility Permits, the Morris County Solid Waste Management Plan, the Bid Documents, including the Contract, and all Applicable Laws. Bidders may collaborate with other firms to submit Bids for the Contract, however, the Authority will enter into a Contract with only one (1) entity and that entity shall have full responsibility to conduct the Work, as that term is defined in the Bid Documents, in accordance with the Bid Documents and Applicable Laws. Bids must be in writing on the forms included in the Bid Documents and accompanied by a certified check or bid bond payable to the Morris County Municipal Utilities Authority for an amount not less than ten percent (10%) of the bid on which a Bid is submitted, but in no case shall the amount exceed $20,000.00. Each Bidder must submit its Bid with the Non-Collusion Affidavit included in the Bid Documents. Additionally, and amongst other items to be submitted as set forth in the Bid Documents (See Checklist), each Bidder must submit with its Bid a signed Equipment and Vehicle Certification stating that it owns, leases or controls all the necessary equipment required to accomplish the Work in accordance with the Bid Documents, together with an executed Bidder’s Agreement to Provide Equipment and Vehicles. Should the Bidder not be the actual owner or lessee of any such equipment required, its Equipment and Vehicle Certification shall state the source from which the equipment will be obtained, and in addition, shall be accompanied by a signed certification from the owner or person in control of the equipment required stating that in the event the Bidder is awarded the Contract, it shall provide Bidder with the equipment, together with an executed Third Party Equipment and Vehicle Owner’s Agreement to Provide Bidder with Equipment and Vehicles. Amongst other requirements, each Bidder and each subcontractor, as applicable, must, at the time of Bid submission, be the current holder of valid Solid Waste Facility Permits issued in accordance with N.J.S.A. 13:1E-1, et seq., a valid Certificate of Public Convenience and Necessity in accordance with N.J.S.A. 48:13A-6 (CPCN), and a current A-901 license in accordance with N.J.S.A. 13:1E-127, et seq., or, be exempted from same or grandfathered according to Applicable Laws at the time the Bid is submitted to the MCMUA, amongst other items, and must satisfy the Minimum Financial Qualifications, the Minimum Technical Experience Qualifications and the Minimum Technical Disposal Qualifications. Each Bid shall be accompanied by a Consent of Surety for the furnishing of a Performance and Payment Bond as defined in the Bid Documents. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31, et seq. (N.J.A.C. 17:27-1, et seq.) (Equal Employment Opportunity), 42 U.S.C. § 12101, et seq. (Americans with Disabilities Act), N.J.S.A. 52.32.-44 et. seq. (Business Registration), N.J.S.A. 34:11-68 (Wage Records), and N.J.S.A. 52:25-24.2 (Corporation and/or Partnership Owner Information), all as same may be amended, amongst other requirements. Bid Documents may be obtained on or after Monday, October 27, 2014 at the offices of the Morris County Municipal Utilities Authority, during regular business hours between 8:30 a.m. and 4:30 p.m. or by submission to the MCMUA of a written request on or after Monday, October 27, 2014 for postal or overnight delivery to Bidder. Bid Documents shall be made available upon payment of a non-refundable fee of $23.65 for each set of Bid Documents requested plus any postal delivery charges. In the event that a potential bidder obtains the Bid Documents in any manner other than as specified herein, the Authority will not have the contact information of the potential bidder for purposes of issuing bid addenda, if any. The non-receipt of any addenda (in the event that any addenda are issued) and the failure of the bidder to acknowledge the receipt of any and all addenda at the time of bid shall be considered a fatal defect in such Bidder’s submission and said Bid shall be immediately rejected. Therefore, if a potential bidder obtains the Bid Documents in any manner other than as specified herein, said Bidder shall promptly provide written notice to the Authority accordingly. A tour of the MCMUA Transfer Station Facilities for all prospective Bidders shall be held on Tuesday, November 18, 2014. All Bidders are strongly encouraged to attend this tour, the location and time of which are set forth in the Bid Documents. The MCMUA reserves the right to reject any or all Bids, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., and applicable law. Prospective Bidders are cautioned not to rely solely on this Notice to Bidders in preparing their Bids, but to read the Bid Documents in their entirety and comply with all bidding requirements set forth therein.
