Intent:
The City of Yonkers (the “City”) wishes to enter a contract for the refill and monthly rental of 100lb propane cylinders as needed. The City intends to maintain an on hand quantity of 6-8 cylinders at one time. The awarded contractor must guarantee an inventory to supply the requested propane within 24 hours after receipt of order.
Contract Term:
Contract shall be for a term of 6-months with an option to extend for one additional 6-month period
Cylinder Requirements:
All vendor-owned cylinders rented by the City shall remain the property of the vendor. All cylinders must be in good, clean, usable condition with an operable valve or regulator. Cylinders without valves should be capped. In accordance with applicable state and federal laws, the vendor shall be responsible for the hydrostatic testing of all vendor-owned cylinders. All cylinders must be clearly labeled as to the contents of each cylinder and must comply with the U.S. Department of Transportation labeling requirements.
Cylinder Rentals:
The monthly cylinder rental rate shall apply to the total number of cylinders on hand at the end of every month during the contract period. The City will not be charged any additional monthly rental fee when cylinders are exchanged.
Item Substitution:
Any substitution for the awarded item is prohibited. In the event an awarded item is not available during the term of the contract, and is not available from inventory, then the awarded vendor must provide written notification that the item has been discontinued. The vendor must inform the using department and file a written request with the Purchasing Department and be granted approval to substitute, in writing, before any substitution may be made. Requests to substitute shall be accompanied by complete specifications for the proposed substitute item. The City, however, reserves the right to accept or reject the letter and to acquire the supplies or materials in the open market.
