RFP-OAC01-25 - Legal Counsel for Custodial Arraignments

Please read the attached documents related to this solicitation:

1. 1. County’s Assigned Counsel Program for Indigent Representation. Pursuant to §722 of the New York State County Law (“NY County Law”), the County is required to implement a plan for providing legal representation of persons charged with a crime as defined in NY County Law §722-a or are entitled to counsel pursuant to Sections 262 or 1120 of the New York State Family Court Act if such persons are financially unable to obtain counsel (“Assigned Counsel Program” or “ACP”).  A crime is a felony, misdemeanor, or the breach of any law of the State of New York (“State”) or of any local law of a political subdivision of the State, other than a “traffic infraction,” for which a sentence to a term of imprisonment is authorized upon conviction thereof (NY County Law §722-a).  The County implements its Assigned Counsel Program in part by engaging The Legal Aid Society of Orange County, Inc. (“Legal Aid”) as authorized by NY County Law §722(2) and (4).  When Legal Aid is unable to provide legal counsel due to a conflict or when the court orders representation despite such defendants having not met Legal Aid’s financial eligibility requirements, such representation is assigned to a panel of attorneys (“18-b Panel”), which panel is administered by the ACP Administrator who heads the Orange County Office of Assigned Counsel (“ACP Administrator” and “OAC”).
