RFP-LAW01-11 - Provision of Indigent Legal Services

Summary of Specifications:
The Scope of Services includes three components: First Component: The organization will provide legal services when a conflict of interest precludes Legal Aid from representing indigent persons in the following matters and proceedings (except when a conflict of interest precludes the organization from providing representation): (a) Family Court proceedings; or (b) criminal proceedings involving persons who are charged with a crime as defined in Section 722-a of the County Law and who reside or are charged with such crimes within the County: A. Representation of a defendant in all criminal proceedings prosecuted by the District Attorney's Office, from the time of arraignment through the final adjudication, including post-conviction proceedings in County Court and in all Local Criminal Courts; in Grand Jury proceedings; in post-conviction restitution hearings; and in any other proceeding in which representation is mandated by law. B Representation of persons in Family Court proceedings pursuant to an assignment made by the Family Court Judge under Section 262 of the Family Court Act. Second Component: The organization will provide legal services to indigent persons in parole revocation hearings and administrative appeals from parole revocations and parole denials. Third Component: The organization will provide legal services to indigent persons in judicial appeals from criminal convictions and family court dispositions.
