Notice to Bidders
Notice is hereby given that the Town of Cortlandt will receive and publicly open and read sealed bids for:
BROADWAY SIDEWALKS
RIVERVIEW AVENUE TO 5TH STREET

CONTRACT NO. TE 2017.01
at the Town Clerk's Office (914-734-1020) located at Town Hall, 1 Heady Street, Cortlandt Manor, NY 10567, at:
10:00 am (prevailing time), March 15, 2017
The work for bid No. TE 2017.01 consists of installing new curb and sidewalk as well as parking lanes and incidental drainage improvements along Broadway from Riverview Ave to 5th Street.
The Contract Documents may be obtained at the Town Clerk’s Office noted above starting on Monday, February 20, 2017 during regular business hours. A non-refundable Bid Deposit of fifty dollars ($50.00) is required for each contract picked up at the Town Clerk’s office. Checks should be made payable to the "Town of Cortlandt".
The Contract Documents may also be obtained electronically at www.empirestatebidsystem.com beginning on Monday, February 20, 2017. Registration is required to utilize this system.
Bids must be submitted in the form prescribed by the Contract Documents and received by the Town Clerk of the Town of Cortlandt no later than 10:00 am at the prevailing time standard on Wednesday, March 15, 2017. Bids must be sealed and addressed to the Town Clerk at the above address and shall be designated as:

Each bid must be accompanied by a bid security in the amount of not less than five percent (5%) of the total amount of the bid and subject to the conditions provided in the Information for Bidders. Certified Checks shall be made payable to the Town of Cortlandt and are to be held by the Town as a guarantee for the proper execution and delivery of the Contract and bonds to secure the faithful performance thereof. In default of such execution and delivery of Contract and Bonds, the amount of the deposit represented by the check or bid bond shall be forfeited and retained by the Town as liquidated damages.
The contract for completion of the above described work shall be awarded by the Town of Cortlandt to the lowest responsible bidder.
In cases where two or more responsible bidders submit identical bids as to price, the Town of Cortlandt will conduct a coin toss to determine the award. All bidders will be invited to attend.
The Town of Cortlandt reserves the right to waive any informalities in or to reject any or all bids or any part of any bid.
No bidder may withdraw his/her bid within forty-five (45) days after the date of the bid opening.
All insurance carriers must have principle offices in New York State or be authorized in New York State.
Attention of Bidders is particularly called to the requirements as to condition of employment to be observed and minimum wage rates to be paid under contract.
This project is a Federal Aid project, and as such has a DBE subcontract goal of 7%.
Equal Employment Opportunity Goals: 22.6% minority, 6.9% female.
The Bidder to whom the Contract is awarded will be required to furnish performance, and payment bonds from an acceptable Surety Company for an amount not less than 100% of the accepted bid.
This project is subject to the provision of Chapter 605, Laws of the State of New York of 1959, Section 103-A of the General Municipal Law and subsequent amendments, and all Federal requirements.
There are no residence or geographical restrictions placed on bidders of this project.
This project is a Federal Aid project, and as such will adhere to the requirements defined in the NYSDOT “Procedures for Locally Administered Federal Aid Projects” manual and furthermore, NYSDOT Standard Construction Specifications MUST be followed.
The right is reserved to reject any or all Bids. Any inquiries regarding the contract plans and/or specifications must be directed, in writing, to David P. Facchini, PE, Lochner Engineering, 181 Genesee Street Suite 300, Utica, NY 13501 and must be received at least seven (7) days prior to Bid opening
A mandatory Pre-Bid Conference is scheduled for 10:00 AM, Tuesday, February 28, 2017 at Town Hall, 1 Heady Street Cortlandt Manor, NY 10567.
Successful bidder must have an approved NYS Uniform Contracting Questionnaire (CCA-2) on file for contract to be awarded.
Contractor will be required to utilize Equitable Business Opportunities Solution (EBO) NYSDOT’s Civil Rights Monitoring and Reporting software.
Project shall be substantially complete within 120 construction calendar days from Notice to Proceed.
