The work required under this Contract consists of furnishing all supervision, labor and personnel, material, equipment and ancillary support necessary to complete the work described within these specifications. The project work consists of removing and replacing curb and sidewalk on the West side of Route 9A between Kings Ferry Road and Roundtree Lane, a distance of approximately 0.28 miles. All materials and work shall conform to the current Standard Specifications, Construction and Materials, NYS Department of Transportation (latest revised January 1, 2019) for this project with the Exception: THE USE OF RECYCLED MATERIALS SHALL BE PROHIBITED AS PART OF THIS CONTRACT.

10:00 AM EST, Friday January 25, 2019
The work for bid TE 2018.03 consists of removing an existing asphalt sidewalk and reconstructing new curbing and concrete sidewalk along Albany Post Road / Route 9A.
The Contract Documents may be obtained at the Town Clerk’s Office noted above starting on December 26, 2018 during regular business hours. A non-refundable Bid Deposit of fifty dollars ($50.00) is required for each contract picked up at the Town Clerk’s office. Checks should be made payable to the "Town of Cortlandt".
The Contract Documents may also be obtained electronically at https://www.bidnetdirect.com/new-york beginning on December 26, 2018. Registration is required to utilize this system.
Bids must be submitted in the form prescribed by the Contract Documents and received by the Town Clerk of the Town of Cortlandt no later than 10:00 am at the prevailing time standard on January 25, 2019. Bids must be sealed and addressed to the Town Clerk at the above address and shall be designated as:

Each Bidder must furnish, with his Bid, Bid Security in the amount of not less than five percent (5%) of the amount of the Base Bid. This security may be in the form of a certified check payable to the "Town of Cortlandt", a bid bond, or cash. Securities are to be held by the Town as a guarantee for the proper execution and delivery of the Contract and bonds to secure the faithful performance thereof. In default of such execution and delivery of Contract and Bonds, the amount of the deposit represented by the check or bid bond shall be forfeited and retained by the Town as liquidated damages.
No bidder may withdraw his/her bid within forty-five (45) days after the date of the bid opening.
All insurance carriers must have principle offices in New York State or be authorized in New York State.
Attention of Bidders is particularly called to the requirements as to condition of employment to be observed and minimum wage rates to be paid under contract. This Contract is subject to the prevailing wage determination made by the New York State Department of Labor. Consequently, this contract will also be subject to the Prevailing Wage Determinations of the Davis-Bacon Act. The higher of the two wages must be paid.
This project is a Federal Aid project, and as such has a DBE subcontract goal of 0%, EEO goals of 6.9% female, 22.6% minority. There are no M/WBE goals for this project.
The Bidder to whom the Contract is awarded will be required to furnish performance, and payment bonds from an acceptable Surety Company for an amount not less than 100% of the accepted bid.
This project is subject to the provision of Chapter 605, Laws of the State of New York of 1959, Section 103-A of the General Municipal Law and subsequent amendments, and all Federal requirements.
There are no residence or geographical restrictions placed on bidders of this project.
This project is a Federal Aid project, and as such will adhere to the requirements defined in the NYSDOT “Procedures for Locally Administered Federal Aid Projects” manual. Bidder is referred to PLAFAP Appendix 12-1 and must submit a Disclosure of Lobbying Activities and Non-Collusive Bidding Certification with proposal. NYSDOT Standard Construction Specifications (latest revised January 1, 2019) MUST be followed.
The Town of Cortlandt reserves the right to reject any and all bids, to waive any informality therein, or to award the Contract to any Bidder if deemed to be in the best interest of the Town to do so.
Any inquiries (errors, omissions, conflicts, ambiguity, etc…) regarding the contract plans and/or specifications must be directed, in writing, to Michael Preziosi, P.E., Director of Technical Services, 1 Heady Street, Cortlandt Manor, NY 10567 and must be received at least seven (7) days prior to Bid opening. The Town of Cortlandt will maintain an Official Plan Holders List. Addenda will be uploaded to bidnetdirect.com, included with hard copies for pick-up and emailed to bidders that have elected to secure a hard copy. Contractor shall submit addenda acknowledgement form with bid.
Successful bidder must have an approved NYS Uniform Contracting Questionnaire (CCA-2) on file for the contract to be awarded.
Contractor will be required to utilize Equitable Business Opportunities Solution (EBO) NYSDOT’s Civil Rights Monitoring and Reporting Software.
Project shall be substantially complete within 90 consecutive calendar days from Notice to Proceed.
A mandatory Pre-Bid Conference is scheduled for Wednesday January 9, 2019 at 10:00 AM at the Office of the Director of Technical Services, Town Hall, 1 Heady Street, Cortlandt Manor, NY 10567. (Refer to “Information for Bidders”, Page 3)
