ADVERTISEMENT FOR BIDS
Receipt of Bids: Sealed Bids on forms prepared by the Engineer will be received by the Town of Newburgh until 11:00 AM (local time) on October 7 2021, for the Desmond Estate Exterior Painting (Re-Bid) in accordance with the Drawings, Specifications, and other Contract Documents prepared by McGoey, Hauser and Edsall Consulting Engineers, D.P.C., 33 Airport Center Drive, Suite 202, New Windsor, New York 12553.
Bids shall be received at the Town Hall, 1496 Route 300, Newburgh, N.Y. until 11:00 AM, prevailing time on Thursday, September 30, 2021 at which time and place they will be publicly opened and read aloud at the offices of the Town Clerk, 1496 Route 300, Newburgh, NY 12550 To examine the Information for Bidders, Drawings, Specifications and other Contract Documents online, at no expense, contact MHE at (845) 567-3100 or email same at mheny@mhepc.com.
Digital copies of the Contract Documents will be available as of 17 September 2021. Said copies may be obtained online as a download from a secure Dropbox link, upon receipt of a non-refundable Fifty Dollar ($50.00) fee, paid by check made payable to McGoey, Hauser & Edsall, D.P.C. Only persons whose name and address are on the official record of having obtained the Contract Documents will be permitted to bid and issued the Addendums, if any.
Complete hardcopy sets of bidding documents are available upon special request for an additional fee.
Bids shall be submitted in a sealed, opaque envelope and appropriately marked with the name of the bidder, project and date and time of the bid opening. All bids shall be mailed or hand delivered to: TOWN CLERK, TOWN OF NEWBURGH, 1496 Route 300, Newburgh, NY 12550.
Each bid shall be accompanied by an acceptable form of Bid Guarantee in an amount equal to at least five (5) percent of the amount of the Bid payable to the Town of Newburgh as a guarantee that if the Bid is accepted, the Bidder will, within fifteen (15) days after the award of the Contract, execute the Contract and file acceptable Performance and Labor and Material Payment Bonds and Certificate(s) of Insurance.
Each proposal must be accompanied by an Offer of Surety (Schedule 2), signed by the bidder and by the proposed surety.
OWNERS RIGHTS RESERVED: The Town of Newburgh, hereinafter called the Owner, reserves the right to reject any or all Bids and to waive any informality or technicality in any Bid in the interest of the Owner.
STATEMENT OF NON-COLLUSION: Bidders on Contracts are required to execute a non-collusive bidding affidavit pursuant to Section 103d of the General Municipal Law of the State of New York.
Attention of bidders is particularly called to the requirement as to conditions of employment to be observed and the minimum wage rates to be paid under the Contract, Section 3, Segregated Facilities, Section 109, and Executive Order 11246.
Bidders are also required to comply with the provisions of Section 291-299 of the Executive Law of the State of New York.
Pursuant to General Municipal Law108, the bidder stipulates and agrees that any agreement shall be void and of no force or effect unless the person, entity or corporation making or performing such agreement secure compensation for the benefit of, and keeps insured during the life of such agreement its employees, in compliance with the Workers’ Compensation Law.
The Contractor shall furnish promptly upon demand by the Owner proof that said insurance remains in full force and effect.
The Contractor’s failure to procure or maintain said insurance shall constitute an act of default and entitle the Owner to terminate the Contract (as set forth in General Conditions or, at the Owner’s sole discretion, shall entitle the Owner to procure and maintain such insurance on behalf of the Contractor and at the Contractor’s sole expense, and to charge the costs of all premiums against the Contractor’s payment requisitions for the period in question.
The bidder shall make allowance in his bid for any price increase in labor and materials. Requisitions for work and/or material shall be at the price bid with no additional charges for such increases.
No bidder may withdraw his bid within forty-five (45) days after the actual date of the opening thereof.
Subject to the provisions of Article 28, Part III of the New York State Tax Law and the provisions of the Contract Documents, the Owner is exempt from payment of sales and compensating use taxes of the State of New York and cities and counties on all materials supplied to the Owner pursuant to this contract.
The Town of Newburgh hereby notifies all bidders that it will affirmatively insure that in regard
to any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the ground of race, gender, color or national origin in consideration of an award.
