INVITATION TO BID
Sealed bids will be received by the Town Board, of the Town of Newburgh, for the following contract:
Roseton Sewer District Improvements
Bids shall be received at the Town Hall, 1496 Route 300, Newburgh, N.Y. until 11:00 am, prevailing time on September 27, 2019, at which time and place they will be publicly opened and read aloud.
Plans, Specifications and Contract Documents for the proposed work are on file and publicly exhibited at the Town Hall, 1496 Route 300, Newburgh, New York 12550 on or after August 30,2019. The said plans and specifications may be obtained from the Town Clerk, at the Town of Newburgh at the above address, in person or by mail. The Contractors shall leave their names and correct mailing addresses upon receipt of the plans and specifications.
The project involves a force main interconnection between two collections systems, a bore under Route 9W, and wastewater treatment plant modifications. The project is to be bid as a general and electrical contract with one (1) “Add Alternate” to conduct improvements to a second treatment plant. Time is of the essence for this project.
A deposit check will be required for each set of plans and specifications distributed, which amount will be refunded only to those submitting formal bids and if said plans and specifications are returned in good condition, within two (2) weeks after their bids have been received.

Bids shall be submitted in a sealed, opaque envelope and appropriately marked with the name of the bidder, project and date and time of the bid opening. All bids shall be mailed or hand delivered to: TOWN CLERK, TOWN OF NEWBURGH, 1496 Route 300, Newburgh, NY 12550.
Each bid from a Contractor must be accompanied by a bid bond or certified check, payable to the Town of Newburgh, in the amount of five-percent (5%) of the total amount of the bid as security therefore. The bid bond or certified check shall be returned or refunded to the bidder on the condition that if the bid is accepted by the Owner, the bidder shall enter into a contract for the same, within ten (10) days after notification of award of contract. If no contract is awarded within 45 days of submittal of the bid, the bid may be withdrawn and the bid bond or certified check shall be returned or refunded. Each proposal must be accompanied by an Offer of Surety (Schedule 1), signed by the bidder and by the proposed surety.
At the time of execution of the Contract, the Contractor shall furnish the Owner the necessary bonds approved by the Town Attorney as to form and sufficiency. The required bonds shall be substantially conditioned to provide that the Contractor shall faithfully perform the Contract on his part, and shall satisfy all claims and demands incurred for the same, and shall indemnify the Town against any and all claims for damage on account of work performed under the Contract.
The Contractor shall procure and maintain, at his expense, until final acceptance by the Owner of the work covered by the Contract, liability insurance for Workmen's Compensation and for bodily injury and property damage, and said insurance shall be kept in full force and effect by the Contractor by payment of the required premiums during the term of the work performed under the Contract.
Pursuant to General Municipal Law § 108, the bidder stipulates and agrees that any agreement shall be void and of no force or effect unless the person, entity or corporation making or performing such agreement secure compensation for the benefit of, and keeps insured during the life of such agreement its employees, in compliance with the Workers' Compensation Law.
The Contractor shall furnish promptly upon demand by the Owner proof that said insurance remains in full force and effect.
The Contractor's failure to procure or maintain said insurance shall constitute an act of default and entitle the Owner to terminate the Contract (as set forth in General Conditions, Article XIII) or, at the Owner's sole discretion, shall entitle the Owner to procure and maintain such insurance on behalf of the Contractor and at the Contractor's sole expense, and to charge the costs of all premiums against the Contractor's payment requisitions for the period in question.
All bids shall be submitted subject to the following conditions:
1. The Town Board reserves the right to reject any or all bids and re-advertise for new bids.
2. All bidders shall submit proof of responsibility, as required by the Town Board.
3. Each bid must contain the certificate of non-collusive bidding required by Section 103 -d of the General Municipal Law, relating to non-collusion (Schedule 4 hereto).

103-a and 103-b.
5. No bids shall be withdrawn for a period of forty-five (45) days after the receipt thereof, without the consent of the Town Board of the Town of Newburgh.
6. The bidder shall make allowance in his bid for any price increase in labor and materials. Requisitions for work and/or material shall be at the price bid with no additional charges for such increases.
