Sealed Bids, pursuant to Local Government Code Chapter 252, will be received for the Wastewater Treatment Plant Phase III Expansion construction project by the City of Buda – Finance Department, 405 E. Loop St. Bldg. 100, Buda, Texas until 2:00 PM local time on January 29th, 2019. Immediately thereafter, the bid proposals will be publicly opened and read aloud in the Council Chambers at Buda City Hall located at 121 Main Street. The project generally includes but is not limited to construction of improvements to expand the existing wastewater treatment plant including headworks screening and grit removal facility; odor control system; influent lift station; influent splitter box; aeration basins; a clarifier splitter box; final clarifiers; return sludge pump station; scum pump station; chlorine contact basins; effluent filters; effluent pump station; chemical feed facilities; standby emergency generators; retaining wall, stormwater pond, drainage and site civil improvements, influent gravity sewer, and all other facilities and improvements as indicated on the PLANS and in the Specifications.
The project Plans and Specifications define an Interim III (1.75 MGD) Permit Phase milestone, consisting of improvements required for operation of the WWTP at flow rates up to 1.75 MGD Annual Average Flow; and a Final (3.5 MGD) Permit Phase which includes all remaining work under this contract.
Two alternative versions of the paragraph below are presented; delete the version not used. 1) The first version is for a Project that has a single prime construction contract. 2) The second version is for a multiple-prime contract project. Edit the example language in the paragraph below to describe the type of Bid required. For additional guidance, see EJCDC® C-001, Commentary. Edit to suit the Project and Owner’s requirements.
Bids will be received for a single prime Contract. Bids shall be on a lump sum basis, with alternate bid items as indicated in the Bid Form.
The Issuing Office for the Bidding Documents is: City of Buda – Finance Department, 405 E. Loop St. Bldg. 100, Buda, Texas 78610, Victor Castillo, CTCM, Purchasing Manager. Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 8:00 AM to 5:00 PM, and may obtain copies of the Bidding Documents from the Procurement Website as described below.
The purpose of the paragraphs below is to identify the Issuing Office and other locations (if any) where the Bidding Documents may be examined and obtained. The paragraph should also contain information on charges or deposits and refunds for the Bidding Documents, and information on the availability of partial sets of the Bidding Documents. Edit the paragraphs below as required for the Project.
In the first paragraph below, identify the Issuing Office. The term “Issuing Office” (with initial capital letters) is defined in Article 1 of the Instructions to Bidders. It is typically appropriate to have only one Issuing Office for a given project. In the typical case the Engineer serves as the Issuing Office, although other entities such as the Owner, a construction manager, or a third-party reproduction firm can alternatively be the Issuing Office.
In the second paragraph below, identify other locations where the Bidding Documents may be examined. Supplement the list as needed; and make revisions to avoid redundancy with the Issuing Office that has been identified in the first paragraph below.
When compact disc or printed copies of the Bidding Documents are furnished, the Advertisement should indicate the amount charged per set, whether the charge is fully, partially, or non-refundable, and the time frame for returning the Bidding Documents for refunds if applicable. Such provisions may be governed by statute.
Three alternative versions of the paragraph below are presented; delete the versions not used. Note that variations on these three options are possible. (a) The first version is for use when only printed copies of the Bidding Documents will be available and when the document deposit charge is fully or partially refundable. (b) The second version is for use when the principal mode of transmitting the Bidding Documents will be in electronic format on a compact disc (CD) with printed Bidding Documents also available as an alternative; the second version includes language that the document charge is non-refundable. (c) The third version is for use when the Bidding Documents are to be obtained from a third-party (such as an outside reproduction firm) that serves as the Issuing Office, and includes alternative language for downloading the Bidding Documents from a website, and printed Bidding Documents. Document charges from third-party reproduction firms are typically non-refundable.
The following is example language. Third-party reproduction firms vary significantly in their approaches to distributing Bidding Documents. Discuss carefully with the prospective Issuing Office the procedures, costs, and alternatives available for distributing Bidding Documents, and edit the following paragraph to suit the Issuing Office and the Project.
Bidding Documents may be viewed and ordered online by registering with the Procurement Website as described at http://ci.buda.tx.us/137/Purchasing. The City of Buda has partnered with BidNet as part of the Texas Purchasing Group and will post bid opportunities to this site. Prospective Bidders must register with the Procurement Website as a plan holder, even if the Contract Documents are obtained from a plan room or other site. The documents are made available for the sole purpose of obtaining Bids for completion of the Project and permission to download does not confer a license or grant permission or authorization for any other use. Authorization to download documents includes the right for Bidders to print documents for their sole use, provided they pay all costs associated with printing or reproduction. Printed documents may not be re‑sold under any circumstances.
All official notifications, addenda, and other documents will be offered only through the Procurement Website. The Procurement Website will be updated periodically with Addenda, lists of interested parties, reports, or other information relevant to submitting a Bid for the Project.
The cost of printed Bidding Documents from the Procurement Website will depend on the number and size of the Drawings and Project Manual, applicable taxes, and shipping method selected by the prospective Bidder. Cost of Bidding Documents and shipping is non-refundable. Upon Issuing Office’s receipt of payment, printed Bidding Documents will be sent via the prospective Bidder’s delivery method of choice; the shipping charge will depend on the shipping method chosen. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of the Bidding Documents will not be available from the Procurement Website.
The paragraphs above are based on electronic Bidding Documents being distributed as PDF files. If other types of files will be available, such as native CAD files or building information models (BIM), edit the Advertisement accordingly, and review the provisions of EJCDC® C-001, Narrative Guide, regarding file formats other than PDFs.
Coordinate the paragraph below with Article 6 of the Instructions to Bidders; to reduce the potential for conflicts, avoid specifying the information in both documents.
When attendance at the pre-bid conference is mandatory (e.g., if Owner instructs that it will not accept a Bid from a Bidder that did not attend the pre-bid conference), edit the paragraph below accordingly. Coordinate with the provisions of Article 6 of the Instructions to Bidders, as required.
A pre-bid conference will be held at 2pm local time on January 8th, 2019 at the City of Buda City Hall, 405 E. Loop St. Bldg. 100, Buda, Texas. Attendance at the pre-bid conference by prospective bidders will be mandatory for acceptance of bid.
In the paragraphs below, edit to conform to the Bidding Documents for this Contract. See Instructions to Bidders.
Bid security shall be furnished in accordance with the Instructions to Bidders.
When applicable, include a provision to the effect of, “Bids will be accepted only from Bidders prequalified by the Owner. Contact [insert Owner contact person name and contact information] to obtain prequalification requirements.” Edit to suit the Project, or use alternative language when other qualifications requirements are sufficiently important to warrant including them in the Advertisement.
Bidders shall submit proof of qualifications to perform the Work as described in the Instructions to Bidders.
